18895 Now, therefore, based on the above findings, TI3E CITY OF EUGENE DOES ORDAIN AS FQLLOWS: Section. 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required and no valid objections have been made at the hear- ing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the street. Section 2. The hearing was concluded on the Sth day of June, 1981, and on December ?, 1981, at 7:30 p.m., Pacific Standard Time, at the Council Chambers, City Hall, Eugene, Lane County, Oregon, the Council considered the task team's report, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described street is hereby vacated, and the street so vacated shall revert pursuant to the statutes. of the State of Oregon. Section 4. The City Recorder is hereby directed to file a certified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certi- fied copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor. Section 5. The street vacation described herein is necess i- tated by reason of construction in connection with the Performing Arts Center and Convention Center. It is in the public interest that the vacation be immediate~.y effective in order to meet dead- lines in that construction activity and therefore, an emergency is hereby declared to e~ist~ and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
