ORDINANCE NO. 18923 <br />AN ORDINANCE CONCERNING LAND DEVELOPMENT AND <br />THE WILLAMETTE GREENWAY; AMENDING SECTION 9.259 <br />OF THE EUGENE CODE, 1971.; ADDING A NEW SECTION <br />9.264 To THAT CQDE; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 9.259 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />9.259 Develo meat in Accordance with Planned Unit Development, <br />Conditional Use Permit, or Site Review Re uirements. <br />The development of land within the corporate limits of the city <br />shall be accomplished in accordance with Planned Unit Develop- <br />ment Regulations x.9.505 - 9.520} or Site Review Procedures <br />~ 9.6 86 ~- 9.694 } whenever required by the provisions of the <br />General Plan and refinements thereof, development map or any <br />other applicable plan adapted by the city. <br />Section 2. There is hereby added to the Eugene Code, 1971, a <br />new section, to be numbered and provide: <br />9.260 Willamette Greenway. <br />~ 1 }^ The development of land within the corporate <br />limits of the city and the boundaries of the Willamette River <br />Greenway shall be accomplished in accordance with Planned Unit <br />Development Regulations X9.508 - 9.524} or Conditional Use Pro- <br />cedures X9.696 - 9.722} . <br />~2} Findings. Prior to Planned Unit Development or <br />Conditional Use Permit approval, the granting authority shall <br />include the following findings, that to the greatest possible <br />degree: <br />~a} The intensification, change of use, and de- <br />velopment will provide the maximum possible landscaped <br />area, open space, or vegetation between the activity <br />and the river; <br />~.b} Necessary public access will be provided to <br />and along the river by appropriate legal means. <br />~3.} Public hearing and notice. Provision shall be <br />made for at least one public hearing on each application to <br />allow any interested person an opportunity to speak.. Notice <br />of such hearing shall be given at least to owners of contiguous <br />property to carry out the purpose and intent of the Willamette <br />River Greenway Statutes. Notice shall also be given to the <br />Oregon Department of Transportation by immediately forwarding <br />Qrdinance - l <br />
