ORDINANCE NO. 18923 AN ORDINANCE CONCERNING LAND DEVELOPMENT AND THE WILLAMETTE GREENWAY; AMENDING SECTION 9.259 OF THE EUGENE CODE, 1971.; ADDING A NEW SECTION 9.264 To THAT CQDE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 9.259 of the Eugene Code, 1971, is hereby amended to read and provide: 9.259 Develo meat in Accordance with Planned Unit Development, Conditional Use Permit, or Site Review Re uirements. The development of land within the corporate limits of the city shall be accomplished in accordance with Planned Unit Develop- ment Regulations x.9.505 - 9.520} or Site Review Procedures ~ 9.6 86 ~- 9.694 } whenever required by the provisions of the General Plan and refinements thereof, development map or any other applicable plan adapted by the city. Section 2. There is hereby added to the Eugene Code, 1971, a new section, to be numbered and provide: 9.260 Willamette Greenway. ~ 1 }^ The development of land within the corporate limits of the city and the boundaries of the Willamette River Greenway shall be accomplished in accordance with Planned Unit Development Regulations X9.508 - 9.524} or Conditional Use Pro- cedures X9.696 - 9.722} . ~2} Findings. Prior to Planned Unit Development or Conditional Use Permit approval, the granting authority shall include the following findings, that to the greatest possible degree: ~a} The intensification, change of use, and de- velopment will provide the maximum possible landscaped area, open space, or vegetation between the activity and the river; ~.b} Necessary public access will be provided to and along the river by appropriate legal means. ~3.} Public hearing and notice. Provision shall be made for at least one public hearing on each application to allow any interested person an opportunity to speak.. Notice of such hearing shall be given at least to owners of contiguous property to carry out the purpose and intent of the Willamette River Greenway Statutes.
