<br />AN ORDINANCE CONCERNING HANDBILLS; AMENDING
<br />SECTIONS 4.045, 4.050 AND 4.060 of THE EUGENE
<br />CODE, 1971, REPEALIiJG SECTIONS 4.055 AND 4.070
<br />of THAT CODE; AND DECLARING AN EMERGENCY.
<br />THE CITY of EUGENE DOES ORDAIN AS FoLLOwS:
<br />Section 1. Section 4.045 of the Eugene Code, 1971, is hereby
<br />amended to read and provide:
<br />4.045 Definitions. For the purposes of sections 4.045 to
<br />4.075, the following words and phrases shall mean:
<br />Bill distributor. A person, firm or corporation
<br />disseminating information by means of handbills,
<br />either for others for hire or not, or for the distri-
<br />butor's own purpose. However, nothing herein shall
<br />apply to the distribution of material delivered by or
<br />through the United States mails, or to the distribu-
<br />tion of newspapers or other literature ordered by or
<br />sold to the owner ar occupant of the premises.
<br />Handbill. A sample, leaflet, dodger, advertising
<br />circular, folder, booklet, letter, pamphlet, sheet,
<br />poster, sticker or banner, but not a newspaper or
<br />other publication printing news of a general nature or
<br />keeping space therein open to the public for the pub-
<br />lication of general advertising matter.
<br />Section ~. Section 4.054 of the Eugene Code, 1971, is hereby
<br />amended to read and provide:
<br />4.050 Affixing, Fainting, Etc., Advertising Matter to
<br />Streets, Trees, Etc. No person shall affix a notice,
<br />placard, bill, handbill, card, advertisement or other paper
<br />on a sidewalk, crosswalk, curb or curbstone, or a portion or
<br />part of a public way or public place, or a lamp post, electric
<br />light, telegraph, telephone pole or railway structure, hydrant,
<br />shade tree or tree-box or on the peers, columns, trusses,
<br />girders, railings, gates or other parts of a public bridge or
<br />viaduct, or other public structure or building, or on a pole,
<br />box or fixture of the fire alarm or police telegraph system,
<br />except as may be authorized or required by the laws of the
<br />United States, State of Oregon, this code or other ordinances.
<br />Section 3. Section 4.055 of the Eugene Code, 1971, is hereby
<br />repealed.
