18963 <br />Section 4. Section 4.44 of the Eugene Code, 1971, is hereby <br />amended to read and provide: <br />4.464 Distribution on Private Property. <br />~1} No person shall distribute or in any manner place <br />a handbill on premises, if requested not to do so, or if there <br />is placed on the premises in a conspicuous position near the <br />entrance, a sign stating: "~o Trespassing," "No Peddlers or <br />Agents," "~~o Advertisement," or similar notice, indicating that <br />the occupants of the premises do not desire to have their <br />right of privacy disturbed, or have handbills left on the pre- <br />mises. <br />{2} i~o person shall distribute a handbill to or on <br />premises when it is apparent that a previous days distribu- <br />tion of a handbill has not been removed. <br />~3} ~~o person shall distribute a handbill to or on <br />premises unless the handbill is folded or otherwise prepared <br />or placed so that it will not be blown therefrom by the wind. <br />~4} No person other than the owner shall distribute <br />or in any manner place a handbill in or on an automobile or <br />other vehicle. The provisions of this section shall not pro- <br />hibit the handing, transmitting or distributing of a handbill <br />to an operator or occupant of a vehicle who is willing to <br />accept the same, nor shall it prohibit the city or its designees <br />from placing on vehicles that have violated a parking ordinance <br />or are suspected of being in violation of parking regula- <br />tions, parking citations, warnings, and information pertain- <br />ing to transportation. <br />Section 5. Section 4.474 of the Eugene Code, 1971, is hereby <br />repealed. <br />Section ~. what the matters contained herein concern the public <br />welfare and safety and therefore, an emergency is hereby declared to <br />exist, and this ordinance shall become effective immediately upon <br />its passage by the City Council and approval by the Mayor. <br />Passed by the City Council this <br />12th day o f May , l 9 ~3 2 <br />City Record <br />Approved by the Mayor this <br />12th day of May, 1982 <br />P~ayor <br />ordinance - 2. <br />
