B1 Oppose <br />Comments: <br />Bill is very unclear on scope, process, timing and overall impact. Very difficult to evaluate <br />as written. Could affect every jurisdiction upstream of any waterway which provides a <br />source of drinking water for their own or any other community (i.e. Willamette and <br />McKenzie Rivers and all their tributaries). Could also affect every well and reservoir <br />statewide. For Eugene, this <br />responsibility would fall to EWEB. The legislation outlines specific zoning requirements <br />for the protection of water supplies, and "When the permitted uses of an underlying zone <br />or local government conflict with the permitted uses of an overlay zone, the more <br />restrictive rule shall apply." This will create conflicts and contentious issues if the water <br />supply overlay zone extends beyond the urban limits. <br />SB 0492 <br />Relating Clause: Relating to just compensation for the condemnation of property. <br />Title: <br />Allows condemner to offer just compensation to property owner without prior attempt at <br />agreement if condemner determines just compensation amount is less than $500.
