ORDINAiQCE NO . ~_~ <br />An Ordinance initiating the vacation of the following de- <br />scribed alley, to~-wita <br />The 12~-foot wide alley in Block 4 of Westmoreland <br />as retarded in Book S, Page 26, Lane County, Oregon <br />deeds and records. <br />Reserving herein an easement for public utilities <br />above ground, on ground level, and underneath the <br />ground, and the right of access to construct, re-~ <br />construct, and maintain the same over the above de- <br />scribed property. West Towne Plaza Assn Av 79--13 <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. The City Council of the City of Eugene herein ini~ <br />bates the vacation proceedings on its own authority without peti- <br />tion ar consent of the property owners, except as provided by sta~ <br />tute, of the above described alley. <br />Section 2. A hearing shall be held upon the proposal to vacate <br />the alley as herein provided and the hearing shall. be held on the <br />13th day of June, 1979, at 12:~4 o'clock noon, Pacific Daylight Time <br />of said date, at the Council Chambers, City Hall, Eugene, Oregon, <br />at which time all persons will be heard upon objections or sugges-~ <br />bons with regard to the vacation, and at said time the Council will <br />provide far the vacation of the alley or deny such vacations and in <br />case the vacation is made, will provide and make provision for any <br />damages sustained by local assessment. <br />Section 3. The City P~ecorder is hereby directed to immediate- <br />ly publish once each week for four consecutive weeks in a newspaper <br />published in Eugene, Lane County, Oregon, notice of the proposed <br />vacation. The notice shall give a description of the area to be <br />vacated as herein set out; state the date when this ordinance was <br />
