Duplex division lot. The planning direc- <br />tor may in his discretion authorize width~ area, <br />and frontage exceptions for duplex division lots <br />in accordance with sections 9.060CllCa}1., 9.060 <br />(1) (a)3., and 9.060Cll.Ca}"4. where there appears to <br />be no reason not to allow the division of an exist- <br />ing conforming duplex lot containing one two-family <br />dwelling (duplex) provided the original 'lot con- <br />tains at least 10,000 square feet of area and the <br />resulting duplex division lots are relatively equal <br />in size - a ten percent deviation or less and a <br />minimum area of 4,500 square feet, reasonable <br />amount of frontage, and a minimum average width of <br />not less than 45 'feet. Assurance must be provided <br />that each unit establish independent utility ser- <br />vice, including but not limited to water, electric, <br />and natural gas, unless common utilities are <br />approved by the affected utility agency and are <br />adequately covered by easements. A single-family <br />structure. could be created only if each lot resuit- <br />ing from a duplex division satisfies the general <br />requirements of width, depth, a~d frontage other <br />than duplex division lot exceptions specified in <br />section 9. 060 Clt Cat. <br /> <br />5. Dupl'ex divis.ion lot - agreement. Prior <br />to. granti~~ fin~l ~pproval fo~ cxe~tion of a.duplex <br />di visi_on lot the J?lanni~g di.rector may 'require. the <br />applicant~l. to enter into a written agreement, in <br />a form approved by the city attorney, that estab- <br />lishes the rights, responsibilities and liabilities <br />of the parti~s with respect to maintenance and use <br />of any common qreas of the duplex such as, but not <br />limited to common walls, roofi~g, water pipes and <br />electric~l wiring~ Such agreement shall be in a <br />form suitable for recording, and shall be bindtng <br />upon the heirs, executors', administrators and <br />assigns of the parties~ <br /> <br />Section 5.
