~s~sl <br />Location of the line along the route described on Exhibit "A" <br />hereto necessitates the acquisition by the City of permanent ease- <br />ments as described therein, which in the City's judgment constitutes <br />the most beneficial and practical location for the line.. Now, there- <br />fore, <br />THE CI Ty of EUGET3E DOES aRDAIN AS FOLLq~!~S <br />Section 1. Based upon the above findings, which are incorporated <br />herein by reference, the City Council of the City of Eugene does <br />hereby find, declare, and determine it necessary to acquire certain <br />ownership in permanent easements for the route of the Pierce-Jefferson <br />115 kV Transmission Line, as described on Exhibit "A", attached hereto <br />and incorporated herein by reference, in order to erect and maintain <br />electric transmission and distribution lines w~.th appurtenances over <br />and under the property for use by the Eugene Water & Electric Board <br />and of any of its contract joint users. <br />Section 2. The City Council does hereby direct that the City of <br />Eugene, acting by and through the Eugene water & Electric Board, <br />shall institute proceedings in eminent domain for the condemnation <br />of the above described interests in real property for location of <br />the Pierce-Jefferson 115 kV Transmission and Distribution Lines, and <br />that at least 2d days prior to the filing of any action far condemna-. <br />tion, the Eugene Water & Electric Board shall make a written offer <br />to the owners or parties having an interest therein of a stated .amount <br />as compensation therefor and for any co~pensable damages to remaining <br />property. <br />Section 3. The C~.ty Counc,~l hereby declares that the impravew <br />menu above set forth are for a pub~.ic puxpose, are necessary far <br />Ordinance -- 2 <br />
