A request <br />for an appeal may be made by contacting the Depart~- <br />ment of Public WQrks Building Division in accord- <br />ance with Section 2Q3~c} of the Administrative <br />Code. <br />Tt is a violation of law to occupy this build- <br />ing or to ~remave or deface this native. <br />City Manager <br />City of Eugene <br />By• <br />Designee <br />3. .Whenever such "unsafe to occupy"' notice <br />is posted, the city manager or his designee shall <br />mail to the owner Qf recard and occupant of the <br />building a notice and order reciting the emergency, <br />specifying the conditions which necessitate the <br />posting, and notifying the owner that a hearing <br />may be requested concerning the building at a time <br />and place to be determined. Such notice and order <br />shall be mailed at the end of the next working day <br />following the date of posting. <br />4. No person shall remain in or enter any <br />building whivh has been so posted, except that <br />entry may be made to repair, demolish, or remove <br />such building under permit. Na person shall re- <br />move or deface any such notice after it is posted <br />until the required repairs, demolition, or removal <br />have been completed and a certificate of occupancy <br />issued pursuant to the provisions of the Eugene <br />Code, 1971. <br />5. Whenever a building is posted, regard- <br />less of whether the city manager or his designee <br />determines that abatement procedures should be <br />initiated, the city manager or his designee shall <br />notify the council of the canditions necessitating <br />the posting or posting and abatement. If the <br />city manager or his designee notifies the council <br />that abatement prgceedings should be initiated, <br />or if the property owner or occupant notifies the <br />council in writing that he/she wishes to appeal <br />the posting of the property, the council shall <br />within a reasonable time fig a time and place for <br />a public hearing. Notice shall be mailed by the <br />finance officer to the owner of record of the <br />premises whereon the building is located, natify- <br />Ordinance - 5 <br />
