<br />ordinance amends the land use code to also address stormwater quality from new development via <br />pollution reduction, flow control, oil control, and source control requirements as well as operation <br />and maintenance standards for stormwater facilities. A list of the approved stormwater facilities is <br />shown in Attachment D. <br /> <br /> <br />RELATED CITY POLICIES <br />The City Council adopted the Comprehensive Stormwater Management Plan (CSWMP) in 1993 <br />which provides a policy framework for stormwater services provided by the City. CSWMP includes <br />specific policy direction to: “Create, implement and enforce water quality based drainage standards <br />(structural and non-structural) for new development” (Policies 1.2 & 1.5 and Implementation <br />Measure #P&A7). <br /> <br />The City of Eugene received its first National Pollution Discharge Elimination System (NPDES) <br />permit in 1994, a requirement of the Clean Water Act for communities greater than 100,000 in <br />population. The City’s NPDES stormwater permit was renewed in March 2004. An evaluation of the <br />City’s stormwater management program in light of the new permit requirements identified adoption <br />of stormwater development standards (Attachment E to this AIS: BMP E4) as a gap in the City’s <br />Stormwater Management Plan which needs to be filled in order to remain in compliance with the <br />City’s NPDES permit. <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />The council may: <br /> <br />1.Direct the City Manager to hold a public hearing on the ordinance concerning stormwater <br /> provisions on April 10, 2006. <br /> <br />2.Direct the City Manager to make modifications to the proposed ordinance concerning stormwater <br /> provisions. <br /> <br />3.Take no action. <br /> <br /> <br />CITY MANAGER’S RECOMMENDATION <br />The City Manager recommends that a public hearing on the ordinance concerning stormwater <br />provisions be held on April 10, 2006. <br /> <br /> <br />SUGGESTED MOTION <br /> <br />Move to direct the City Manager to hold a public hearing on the ordinance concerning stormwater <br />provisions on April 10, 2006. <br /> <br /> <br />ATTACHMENTS <br /> <br />A.
