The intersection of West 11 Ave. at Beltline currently exceeds v/c 0.80 in the <br /> PM peak hour; the proposed amendment will worsen the performance of this <br /> transportation facility. <br /> <br />Pursuant to OAR 660-012-0060(2), when a local government determines that a development <br />would significantly affect an existing or planned transportation facility, the local government must <br />put in place measures as provided in OAR 660-012-0060(2) to assure that the allowed land uses <br />are consistent with the identified function, capacity and performance standards (level of service, <br />volume to capacity ratio, etc.) of the facility. <br /> <br />If it is found that there are no measures that will assure that the allowed land uses are consistent <br />with the identified function, capacity and performance standards of the facility, the City could still <br />approve the proposed amendment if the applicant demonstrates compliance with OAR 660-012- <br />0060(3). <br /> <br />OAR 660-012-0060(3) states that a local government may approve a development that would <br />significantly affect an existing transportation facility without an applicant assuring that the allowed <br />land uses are consistent with the function, capacity and performance standards if the applicant <br />can demonstrate that: (a) the transportation facility is already performing below minimum <br />acceptable performance standards on the date the amendment application is submitted; (b) the <br />planned transportation facilities will not be adequate to achieve consistency with the performance <br />standard of the facility by the end of the planning period; (c) the development resulting from the <br />proposed amendment mitigate the impacts of the amendment in a manner that avoid further <br />degradation of the transportation facility by the time of development; (d) the amendment does <br />not involve property located in an interchange area; and (e) for affected state highways, ODOT has <br />provided a written statement that the proposed funding and timing for the identified mitigation <br />improvements or measures, are at a minimum sufficient to avoid further degradation of the <br />performance of the affected state highway. <br /> <br />The applicant proposes compliance with the TPR pursuant to OAR 660-012-0060(3). Specifically, <br />the applicant proposes to prevent further degradation of the significantly affected transportation <br />facilities with the imposition of a trip cap that limits the residential units allowed on the subject <br />property. The proposed trip cap would limit the number of residential units allowed on the subject <br />property to 29 single family residences or 50 condominiums.
