unabated violation or hazard shall be the hourly inspection fee established by the City Manager <br />pursuant to Section 2.020 of the Eugene Code, 1971. <br />9. Section 113.2 of the OFC is amended to provide: <br />Section 113.2 Schedule of permit fees. A fee for each permit or reinspection shall be <br />paid as required, in accordance with the schedule established by the City Manager pursuant to <br />Section 2.020 of the Eugene Code, 1971. <br />10. Section 202 of the OFC is amended by adding the following definitions in <br />alphabetical order therein: <br />202 GENERAL DEFINITIONS <br />FIRE CHIEF, FIRE CODE OFFICIAL, CHIEF OFFICER, OR CHIEF OF <br />THE DEPARTMENT is the City Manager or his or her designee. <br />QUALIFIED PERSON OR COMPANY means a competent and capable <br />person or company that has met the requirements of the Fire Code Official, which <br />may include written tests, field testing or acceptable formal training for a given <br />field, such as but not limited to water based fire protection systems, commercial <br />kitchen hood suppression systems, fire alarm and detection systems and <br />hazardous materials protection and detection systems. <br />PERSON RESPONSIBLE means an agent, occupant, lessee, tenant, contract <br />purchaser, owner, permit holder, facility owner, or other person in possession or <br />control of the facility, or hazardous materials or of a facility at which hazardous <br />materials are located. <br />11. The definition for `Open Burning" in Section 302 of the OFC is amended to <br />provide: <br />302 OPEN BURNING. The burning of materials wherein products of combustion are <br />emitted directly into the ambient air without passing through a stack or chimney <br />from an enclosed chamber or as regulated by Lane Regional Pollution Authority <br />and Section 6.200 of the Eugene Code, 1971. Open burning does not include road <br />flares, smudgepots and similar devices associated with safety or occupational uses <br />typically considered open flames or recreational fires. For the purpose of this <br />definition, a chamber shall be regarded as enclosed when, during the time <br />combustion occurs, only apertures, ducts, stacks, flues or chimneys necessary to <br />provide combustion air and permit the escape of exhaust gas are open. <br />Administrative Order - Page 6 of 9 <br />
