Council ChambePs, Eugene, Oregon, April 26, lg15. Council met pu,'su~nt to adjournment of .April 12th, and was called to order by Mayor Bell. Present Councilmen Parks, Polders, Bog~e, Peterson, ~.~osheP and Goodpastu~e; absent Devereaux and Burden. The Coim~ittee to whom was referred the question of the eligibility of Councilman ~. A. Burden to hold the Office of Couneilm~n from the Fou~,th ~Vard Filed a w~itten repo~t as to his eligibility to hold said Office to- gethe~ with ~ relinquishment of any claims of C. A. Burden to hold the Office of Couneilm~n From She Fourth Ward filed a written report as to his eligibility to hold said Office together with a relinquist~nent of any claims of ~. A. Burden to the Office, and the Following Resolution was read: RESOLUT ION. WIIEREAS, C. A. Burden, a candidate for the office of Councilman from the Fo~u. th V~ard in the Oit¥ of Eugene, received the g~eatest numbe~ of votes east for said office at said election ~nd was given his seat in the ~ouneil upon the certificate of election which was given to him in due process of law, and W]{EREAS a protest against his holding said office has been Filed by ~,i~. Quimby, a rival candidate for said office at said election, who eeived the next g~eatest number of votes cast for said office, at s~id election, and '¢~EREAS upon an investigation it has been determined that there is some question as to the eligibility of ~. Burden to hold said office, and Nr. Burden having expressed his desire that he retire from the contest at this time, all of which appears in ~ report on File from the Co_~ittee to whom said question was referred, NOW ~IIEREFORE, BE IT RESOLVED, BY ~{E CO~0N COUNCI5 OF ~{E CITY OF EUGENE., that C. A. Burden, Councilman elect from the Fourth 'Nard, is ineligible to hold said office, and further Resolved that E. E. Quimby, having received the next greatest number of votes cast fop said office at said election is entitled to hold said office of Councilman from the Fourth Ward. " ~.~otion was made, seconded and e~rried to adopt the Resolution. At this time E. E. Quimby appeaPed and was duly ~orn to perform the duties of Councilman from the 5~ou~th Ward and took his seat in Council.
