Kinc~ld presented to the Co,non Jouneil the City of Eugene, Oregon, a communication in writing, now on file in the office of the City Recorder, wherein he set fo ~th that he was the owner of the 1 md to be taken and used for the opening of 13th Avenue insald city, from Olive Street, to Charnelton Street, ~nd that he would convey such land ~o the city for such street purpose on ce~taln ~erms and conditions therein set forth, ~ubst~tlally as follows: That the city would grade that part of the Avenue so conveyed, construct the necessary sidewalk, curbing ~d p~rking thereon, ~nd the sewer or se-~vers therein, and pave or maead~lze the s~e at its d~s~re~!o~nd~m~ln~l~t~ltof the seiki lmpm~ve- merits, all at.public cost ami expense and without any charge o~ assessment or asse~s- merits upon the abutting property se long as 1~ w~ c~ed by him; WI{~E~M, on May 26tH, 1924, the Co~on Co~mdll of the city passed ~d ~ntered of record a resolution accepting the offer som~; ~d, WHENEAS, in pursuance of said offer and the acceptance thereof the said Webster h.
