<br />chapt'er the:fete, authorizing ahd empo.wering the COrn,men Council of the City of
<br />gene, for the I~urpcse cf sec.uring an adequate supply of pure Water for said city
<br />and i~s inhabit;ants, and of extending its water system, to secure by purchase,
<br />condemnation er otherwise )~ithin cr without the city any and all real estate,
<br />rights of way, water rights, easements and licenses, to hold,~ control and lease
<br />the same, and to cOn.~truct dam~, reservoirs, pipelines, conduits, structures and
<br />appliances of every kind,, reasonabl~ and necessary, to institute, prosecute,
<br />maintain and defend all .~uits actions andproceedings necessary to such purpose,
<br />and tc issue and sell the negotiable bonds of the city in the sum of Three
<br />dred Seventy Five Thousand Dollars, or so much. theree'f as may be necessary.

<br /> Section 2; ~o~ the purpoae of m~tng p~ment fo~ such Section one hereof, the
<br />Ce:ranch Council la hereby authorized ~d ~po:~red to issue and sell bhe negotiable
<br />bonds of the City of ~gene to the ~0~% of Three H~md'~ed Seventy i~lve Thous~ad
<br />Dollars or so much thereof as may be necessary f~)~ the completion of said project.

<br /> Seoblon ]. The bonds hereby authorized shall be denominated NoXenzie Water
<br />Bonds, aad shal,1 be tm such form ~d of such denominations as will, in the Judg-
<br />menb of bhe Co~on Counell, be most likely to conduce ~o their s~labillty. They
<br />shall be made due ~d~ p~able ~ln thrlty years· f~om the date of their' issuance, and
<br />shall bea~ intones% at a rate not exceed five per cent per sam~, interest p~yable
<br />s emi- annual ly.

<br /> - S.ee'tibm' 4: S~id bbn'ds~ shall-b'e 'a general 'obllgati'onof the City of EUgene,- --
<br />payable out of the revenues of the water plant ef said city, and the Common Co:m-
<br />oil of the City or'Eugene, is hereby authorized t.o include in its general munlct-
<br />pak tax levy each year such sufficient special levy 'as shall aggregate am amount
<br />sufficient to pay the interest on She bonds and provide a sinking fur for the
<br />[~a~ynfent bf the- bbn~ds- Wheh -du-e. .............

<br /> Ssctlon 5. The Common Council is hereby authorized to issue and sell the said
<br />bonds fr6m time to:time as them may be needed for the purpose herein specified,
<br />but before any of them shall be :sold, they shall be advertised for sale by publlca-
<br />Sion of a notice asked for bid,s therefor be be published in the two daily papers
<br />now published in E~gene, Oregon, or bhelr successors in at least one. issue of
<br />such daily papers, two weeks prior to ,the time oS the sale; and they may also
<br />give notice cf the sale of said bonds in such other papers as they dean to be
<br />bess for the tnteresS of the city in effectlng a sale; but if no satisfactory bids
<br />for the purchase Of the bonds be received, they may sell them at private sale at
<br />not less than a~ par and accrued interest.

<br /> 'Section 6. That the money derived from the sale of said bonds shall constitute
<br />a special fund to be denominated McKen~'l-e Wat'eP~ Fund, and shall be used for no
<br />other purpose than~hereln provided.
<br />
<br /> Section 7. The lneb,edness authorized by this amendment to the Charter of the
<br />City of Eugene, is:in addition to all other indebtedness authorized and incurred
<br />b~ the City of Eugene, and shall not be considered as affected by any limitation
<br />of indebtedness in the Charter of the City or elsewhere.
