1926, by and between W.E. Crews and Louisa Crews, party of the first part, and <br />the City of ~gene, a municipal corporation, party of the second part. <br /> <br /> WITNESSETN; That, ri.consideration of certain conveyances heretofore caused <br />.to he made by the second party t~o the first party, the first party does hereby <br />grant, bargain, sell and convey unto the City of D~gene, a municipal corporation, <br />a perpetual easement and right of w~.y across his property 10 feet each' side of <br />a center line, ~#hlch la described as follows, to-wit: <br /> <br /> Beginning. at a point 1165 feet south %f the South margin of ~3th <br /> Avenue and 1111 Feet North 89'1~! West of the cent er line of <br /> Cha. mberts Street which beginning point is 806 feet sbu%h of the <br /> 'SOuth line of Lot 7, Block 19, Chamber's Addition, and running <br /> 'thenCe north 32~30~ West 807 feet, thence north 72'30~ West 308 <br /> F~et, to a point 91 Feet east of the southwest corn~ r o~ Lot 6, <br /> Block 21, Chamber~ Addition, above description being the center <br /> lin, of a ditch 20 feet wide.lO feet on each side of said line, <br /> s~id right of way being for the purpose of widening and straighten- <br /> ing the AMazon' Slough. <br /> <br />a plat of which is before the ps, ties at the signing hereof. <br /> <br /> 'It is understood and agreed that the City of Dagene, lfl making use of said <br />right of way by th~-excavation of a drainage ditch through the same, sh~ll exer- <br />cise diligence in placing the dirt on the side of the excavation most convenient <br />to the First party/to the fllllng of the old ditch across the property. <br /> <br /> It is further agreed that the second paPt~ shallcommit no waste or injury <br />to any of the property adjacent to said right of way and shall take particular <br />care no~ to out down or injure afly growing trees or shrubbery thereon. The <br />secon,A party agrees to replace the foot bridge &t the eas~ e~d of said ditch. <br /> <br /> The right is hereby gr~n~ed the second party to enter upon said premises <br />whenever necessary and convenient to the construction and maintenance of said <br />ditch.
