<br />of the appointment .of the City Planalng Commission and that hereafter plats af-
<br />fecting the City would not bo filed withou.t ,the approval of such Commission..

<br /> Chairman Simmons of the l~tre and water Committee reported on' the dangerous
<br />opnditlon of the Railway crossing on High St. at 5th Ave. and asked that such
<br />matter be abated. The same was referred to the Pollco Committee.

<br /> The Tire and Water Committee stat~i it had an aPPlication from Mr. ?innie
<br />to build a stucco garage at l139.Wi11~nette St. and asked that such petition be
<br />granted. On motion such report was adopted°
<br />
<br /> The Mayor read a letter from l~rederiek D Strickerof th~ State Board of Health
<br />as to the condition of the outlet of the main trunk sewer in the northwest part
<br />of the City, setting forth certain conditions which must be complied with. Such
<br />matter was referred to the Sewer Committee and the Health Committee retake the
<br />matter up with Mr. Lombard and others interested so as to alleviate the condition
<br />now existing at this point.

<br /> Mayor Parks announced the following as the Planning Commission for the City
<br />and asked that such appointments be affirmed, viz; g.B.Parks, S.Y. Calkins, and
<br />H.E. Devereaux, Ex-Officio, and W.R.B. Willco~..~'Mpzelle Hair, Yrs. F.L. Chambers,
<br />Harry Ruth, DR.N.C.Nelson, E.O.PotteR, Paul Kelty. On motion, unanimously carried
<br />said appointments were confirmed.

<br />WHENEA~, heretofore and on.August 18th, 1925, there was submitted to the
<br />electors of the City of Eugeme, Oregon, for their approval or .rejection an Amend-
<br />ment to the Charter of the City of Eugene, Oregon, authorl~.lng and empowering the
<br />Common Council of said City ~o aequ£re by purchase, condemnation or otherwise
<br />lands .within and without the said City to be used for municipal railroad termin-
<br />als, municipal belt line railroad, municipal parks and any other municipal purpose
<br />and to issue and sell negotiable bonds of said City in the sum of $1V5,000.00, or
<br />somuch thereof ~s shall be ne~cessary fcc such purpose, and to expend the proceeds
<br />in payment therefor, and at said election said amendment received an.affirmatiVe
<br />vote of g028 and negative vote of-_---, of the electors of said City, ~nd thereafter
<br />said bonds were duly and legally advertised, and on the ~th day of September,
<br />1925, s6~d and the proceeds therefrom are in the hands of the City Treasurer, or
<br />Will be immediately. ·

<br /> AND WHEREAS, at ~and prior to the time of s~ld election it was commonly under-
<br />stood and Intended by the legal voters of said City that the entire proceeds from
<br />the sale of said bonds so m~thorized, should be used in acquiring fqr the use
<br />of said City for the purposes aforesaid, the lands hereinafter described.

<br /> AND WHEREAS, the Eugene Terminal Company, .a corppration of Oregon, has been
<br />organized with a capital stock sub. scribed almost exclusively by solvent citizens
<br />.and electors of the City o~ Eugene, for the purpose of aqqulring de~ds and titles
<br />~o said lands for and on behalf, of said City, and said Eugene Ter~minal Company
<br />has arranged to so. quire said titles and has offered to enter into an agreement
<br />with the City of Eugene to convey good titles free of incumbrance to said lands
<br />to said City of Eugene, within a reasonable time, not exceeding 30 days for the
<br />sum of $1V5,000,00, $1VO,O00.O0 of said purchase price to be paid to said Eugene
<br />Terminal Company upon the execution of a valid contract for conveyance of said
<br />lands, and the balance upon approval of the titles by the City, and execution
<br />of deed of conveyance. , ,~

<br /> , N0W THER~i~0RE, BE IT ~[BOLVED, that the Mayor and City Recorder of the City
<br />of Eugene, Oregon, be and they are hereby authorized and directed in the name of
<br />and on behalf of, said Clt¥~ to enter into. ~. contract with ~he said Eugene Terminal
<br />Compsmy whereby said City shall agree to purchase and said Eugene,Terminal Company
<br />shall agree to. Sell the h&relnafter described real progerty, at. the price and sum
<br />of $17§,000.00, and that upon the execution of said contract the City Treasure~
<br />of the City of Eugene, be end he is hereby authorized and d~ected to pay over to
<br />said Eugene Terminal Company out of the proceeds of the sale of said bonds the
<br />sum of $1VO,000.00.

<br /> That said contract shall provide that within a reasonable time ~d not later
<br />than 30 da~s, said EUgene Terminal Company shall convey to the ~it¥ of Eugene,
