City of Eugene ~re hereby authorized ami ,ilreoted to make and execute a good and
<br />sufficient warranty deed to said property -to the said ~gene Service Station,
<br />Inc., and upon payment to the City of .~gen~ of all d~ferre,i rentals and of the
<br />s~ of ~!5,500.00 to deliver said Abst~ct and said warranty deed to the Eugene
<br />Servlee Station, Inc., a corporation. '

<br />The f~lDwing resolution was offered and, on motion, unanimously adopted:

<br /> R E S 0 L U T I 0 N .

<br /> WheWeas, heRetofoWe and on November 29,1913, the City of EUgene instituted
<br />an lnJ~$nction suit against the Ch~nbers Power ComPany, a corporation, and Prank
<br />L. Chanber~, the subject of which suit was to prevent the said F.L. Chambers and
<br />the Chambers Power Company from widening the mill race ~vhere the sane flowed thru
<br />various streets in the City of Eugene, and
<br />
<br /> Whereas, as a companion suit litigation was carried for.,vard between property
<br />owners along the mill race and the said Chsmbers Power Company with a view
<br />to restraining the said Chambers Power Company, the then owner of the mill race,
<br />from widening the sa, ne, and
<br />
<br /> Whereas, all of the litl.:'~ation was terminated by a decision of the'Supreme
<br />Court reported as Patterson vs Chambers Power Company, at page 328, of Vol 81
<br />of the Or~ gon Reports, which decree of said court determined that the said
<br />Chambers Power Company, the then owner of said mill race, be permitted to widen'
<br />tn~ mill race to an aggregate width of 50 feet, and at page 352 of the same ~port
<br />the Court decreed in the case of the City of E~gene vs Chanters Power Company
<br />that the Patterson case determined all the issues in the case of the City of
<br />E~zgene vs Chs~nbers Power Company, and
<br />
<br /> Whereas, the City of ~gene at this ti~ne contemplates the erection of a
<br />ne~ brldge across the mill race at Alder Street, and there is at this time la the
<br />mill race a cement pier which the City (~f Eugene desires to use as a support for
<br />said bridge, wh£chpl~r stands out in the mill race in such a manner that the
<br />present owners of the mill race. C. O. Peterson and Emil A,KoPPe the successors
<br />of the Chambers Power Co., would have the right to demand that saldpier be set
<br />back into the bank of the mill race, and
<br />
<br /> Whereas, the said C 0 Peterson and Emil A Koppe and the officers of the
<br />City hays arrived at a tentative agreement that the City may use the pier con-
<br />structing the bridge in .such a '.manner 'that the support may be later placed further
<br />into the ban}( of the mill race.
<br />
<br /> Now, ther~ fore, Be it Resolved by the Common CounCil of the City of h~gene,
<br />that the Recorder be directed to enter into aa agreement with C 0 Peterson and
<br />~uil A KoPPe the present owners of the Mill race, by the terms of which the City
<br />of Eugene shall be pe~mitted to use the present cement pelt at the' int~'rsec~lou
<br />of Alder Street with the talk1 race, upon the express understanding and agreement
<br />that should the said C 0 PetersO~ and Emil A EoPPe or their heirs or assigns later
<br />desire the obstructim removed, that the City will either move the pier back or
<br />construct a newpier and remove the present cement pelt.
