<br />and Hilyard Street in tHe City of Eugene,Oregon, to a width of 84 Feet;

<br /> Be It ~'es'olved that the Common Council of the City of Eugene,0r~oa,
<br />de,ms it expedient and necessary to open, lay out and establish to a width
<br />of 84 Feet, 19th Avenue east From Patterson Street to .~ilyard'~ Street in the
<br />City of Eugene,Oregon.

<br /> Be It Further Resolved, that the City Englneer be and he is hereby
<br />directed to make a survey of said widening of 19th Avenue east frm~ Patterson
<br />Street to Hi[yard Street, to a width of 8/+ fee~, and to'make a plat thereof
<br />and make a written report thereof containing a full and complete description
<br />of such street andits boundaries, and all portions of lots and parts of lots
<br />or tracts of land to be ~pproprlated therefore, and to file such ~epo~t
<br />with the City ~ecorder of the City of ~gene within 20 days from the date of
<br />this resolution.

<br /> WhEreas, heretofore and on April 5,191~, there was adol~ted by the electors
<br />of the City of EUgene at a general City election held in the City of EUgene
<br />a Charter Amendment as follows:
<br />
<br />"Section 154. That the ~roperty commonly known as the city
<br /> Hall property and situated at the corner of 9~h Avenue and
<br /> Pearl Street and described as follows, to-wit:
<br />
<br />The East half of Dots 1 and 4, in Block 13, of that
<br />part of the City of D~gene, which was originally donated
<br />to Lane County by Charnel Mulligan and wife.
<br />
<br />may be sold by the Co~nmon Council of the City of E~gene for the highest price
<br />obtainable, either by advertised bids or at private sale in the d i.~cretion
<br />of the Council, buS/ not for a price less than the oPlglna[ cost there3f,
<br />wit: $15,500.00 and the proceeds of such sale be used toward the purchase or
<br />acquiring of the High School property on llth Avenue West a~d Will,otto
<br />street for the purpose of a City hall property."

<br /> That pursuant to the authority of sale contained in said Charter ~nendment
<br />the City of E~gene, on the 24th day of January 192~, entered into an agreement
<br />with A.~. T~ffany by the terms of which the said A.M. Tiffany leased the herein-
<br />before described property from the City of ~igene at a rental of'$930.00 pe~
<br />annum, t~ be paid in equal installments of $77.50 per mont.h, a.~d further gran~
<br />ed ~o' the said A.R. Tiffany an option of' purchase at a~y t,~ne within the
<br />of ten years at a purchase price of $15,500.00 and
<br />
<br /> Whereas,_sald contract further provides that ~ny any time that the said
<br />A.~.Tlffany shall make d~ma~d.th~refor and tender $15,500.00 and ail deferr~ed
<br />p~yments of rent, and shall have satisfied the City that all taxes'on said
<br />prope.r, ty_ have been. paid, that ~he City of ~geae shall furnish to the
<br />A.~Tiffany an abstract of Title showing a merchantable title to the said
<br />property and sha~lmake and e~ecu,t8~ ,a goo~l and sufficient deed for said property
<br />to the said A.R. Tiffany, and

<br />as the Eugene Service Station, Inc., a corporation and desires the conveyance
