<br /> eompetatlve bidding: The Lumbe~a~8 Trust Co. and Petroe Fair e,nd Co. submitted
<br /> a bid of Pa~ and aeor~ed interest with a preml~ of.25 per thous~d interest
<br /> ~t 5~. B%y~h, Witte? and Co, submltt¢ ~ bid o~ ~ m54 accrued interest with a
<br /> p~emium of .50 pe~ thoua~d, t~te'¢ast a~ 5~ they to p ~ for the lega~ dptal~;
<br /> the City to p ay for prinbing the bonds. The Lumbermans Truest Co. and ~es~
<br /> Fal~ a~d Co. then increased their bid a~ (ollows~ Bar and accrued interest, wibh

<br /> bids the Chairman of the Fin~ee Co~it~e$ moved the bid of Lumbermans Trust
<br /> Co. and Pet?ce 2~lr and Co. be accepted. The motion wss seconded. The roll was

<br /> appropriated In the opening of Van ~uren Street frmn 3r~[ ~venue to Blair
<br /> Blvd. was taken up and bases of settlement were submitted by R.M. and Lena
<br /> Miller and by Chas. A. and Bertha Mouse. After discussion the following
<br /> resolution was submitted:

<br /> WhEreas the City Council and City of Eugene ha2 heretofore laid out and
<br />platted a street opening through Block Number Eight of 81adden's Addition to
<br />Eugene, and has heretofore made a settlement wl~h H.I. and Eattle i Yanley for
<br />a purchase of a portion of said tract, and
<br />
<br /> Whereas, the City of Eugene at that time was prevented from completeting
<br />said street opening and paving the street as laid out and platted through said
<br />block Number eight, by aa injunction suit instituted by Chas. A. and Bertha D.
<br />Mouse, and
<br />
<br /> Whereas, the remaining owners, R.M. and Lean Miller have stated to the City
<br />that an~ stttlement made that does not include them will result in a further in-
<br />Junction suit, aad
<br />
<br /> Whereas, the City Council has determined that it is essential at this time
<br />for the safety of the travelling public and fo~ the welfare of the City and that
<br />it is necessary that said street be immediately opened and paved,
<br />
<br /> THERE~0RE, BE IT RESOLVED by the Common Q~unCll of the City ~f Eugene, that
<br />the NaMer, or In ease of his inability, the President of the Co,moll together
<br />with the City Attorney of Eugene, shall negotiate and complete a settlement of
<br />the claims involving said properties amd said street upon a basis of:

<br /> 1. Pa¥in~ to R.M. and Lena Niller $800.~0 damages for ProPerty taken, reserv-
<br />ing tc the City theprivile~e of assessing to the saiA Mlller property the cost
<br />of paving the side of Van Burem Street opposite their property, er
<br />
<br />Negotiating the sale of the Miller lot upon a basis ef paying R.N.
