9.7210 Notice of Application. <br />(1) Within 10 days of the city's determination that an application is complete, but <br />no less than 20 days before the planning director makes a decision, written <br />notice of the application shall be mailed to all of the following: <br />(a) Applicant. <br />(b) Owners and occupants of the subject property. <br />(c) Owners and occupants of properties located within 300 feet of the <br />perimeter of the subject property. <br />(d) Neighborhood group or community organization officially recognized by <br />the city council that includes the area of the subject property. <br />(e) Community organizations that have submitted written requests for <br />notification. <br />(f) For final partitions, final subdivisions, and final PUDs, to interested <br />parties of record from the tentative decision. <br />(g) For modification applications, to persons who requested notice of the <br />original application that is being modified. <br />(2) The notice shall include all of the following: <br />(a) The street address or other easily understood geographical reference to the <br />subject property. <br />(b) The applicable criteria for the decision, listed by commonly used citation. <br />(c) The place, date, and time that comments are due. <br />(d) A statement that copies of all evidence relied upon by the applicant are <br />available for review, and can be obtained at cost. <br />(e) A statement that issues that may provide the basis for an appeal to the <br />Land Use Board of Appeals must be raised in writing and with sufficient <br />specificity to enable the decision maker to respond to the issue. <br />(f) The name and phone number of a city contact person. <br />(g) A brief summary of the local decision making process for the decision <br />being made. <br />(3) The notice shall allow a 14 -day period for the submission of written comments, <br />starting from the date of mailing. All comments must be received by the city <br />within that 14 -day period. <br />(4) If the application being reviewed is for a tentative subdivision or site review, the <br />notice shall be posted in at least 3locations within 300 feet of the perimeter of <br />the subject property. Additionally, at least 1 freestanding sign at least 12 square <br />feet in area for 1 face, or at least 24 square feet in area for 2 or more faces shall <br />be installed on the subject property. <br />9.7215 Decision. Within 45 days of the city's determination that an application is complete, <br />unless the applicant agrees to a longer time period, the planning director shall <br />approve, conditionally approve, or deny a Type n application. The decision shall <br />include a brief statement that explains the criteria and standards considered relevant to <br />Ordinance - 294 <br />
