the decision, state the facts relied upon in rendering the decision and explain the <br />justification for the decision based upon the criteria, standards and facts set forth. <br />9.7220 Notice of Decision <br />(1) Within 5 days after the planning director renders a decision, the city shall mail <br />notice of the decision to the following: <br />(a) Applicant. <br />(b) Owner and occupants of the subject property. <br />(c) Neighborhood group or community organization officially recognized by <br />the city that includes the area of the subject property. <br />(d) Any group or individual who submitted written comments during the <br />comment period. <br />(e) Those groups or individuals who requested notice of the decision. <br />(f) Property owners and occupants of property located within 300 feet of the <br />perimeter of the subject property. <br />(2) The notice shall include all of the following: <br />(a) A description of the nature of the decision of the planning director. <br />(b) An explanation of the nature of the application and the proposed use or <br />uses which could be authorized. <br />(c) The street address or other easily understood geographical reference to the <br />subject property. <br />(d) The name of a city representative to contact and the telephone number <br />where additional information may be obtained. <br />(e) A statement that a copy of the application all documents and evidence <br />submitted by or on behalf of the applicant and applicable criteria are <br />available for inspection at no cost and will be provided at reasonable cost. <br />(f) A statement that any person who is adversely affected or aggrieved or who <br />was mailed a written notice of the planning director's decision may appeal <br />as provided in EC 9.7605. <br />(g) A statement that the planning director's decision will not become final <br />until the period for filing a local appeal has expired. <br />(h) An explanation that a person who is mailed written notice of the planning <br />director's decision cannot appeal directly to LUBA'. <br />(3) Unless appealed according to the procedures in EC 9.705 Filing of Appeal of <br />Planning Director's Decision, the planning director's decision is effective on the <br />13th day after notice of the decision is mailed. <br />9.7225 Approved Site Plans when a Type II application approval requires a final approved <br />site plan, the applicant shall provide the city with 4 copies of plans that meet the <br />conditions of approval of the planning director's decision. <br />9.7230 Expiration <br />(1) The planning director's approval of an application shall expire in 12 months, 18 <br />Ordinance -- 295 <br />
