The recommendation of the lannin commission shall be based on <br />pp p g <br />required approval criteria. <br />9.7435 Cily Public Hearing Schedule. within 60 days of the planning <br />commission's recommendation, unless a longer time frame is agreed to by the <br />applicant, the city council shall conduct a public hearing to consider the planning <br />commission's recommendation. <br />9.7440 Public Hearing Notice. <br />(1) At least 10 days before the city council hearing, the city shall mail written notice <br />of the hearing to all of the following: <br />(a) Applicant. <br />(b) Owner of the subject property. <br />(c) Any person who has submitted written or oral testimony in a timely <br />manner during the planning commission hearing procedures. <br />(d) Any person who requested notice of the planning commission's decision. <br />(2) The notice shall: <br />(a) Set forth the street address or other easily understood geographical <br />reference to the subject property. <br />(b) List the applicable criteria for the decision. <br />(c) State the place, date, and time that comments are due. <br />(d) Explain the nature of the application and the proposed use or uses which <br />could be authorized. <br />(e) State that a copy of the staff report will be available for inspection at no <br />cost at least 7 days prior to the hearing and will be provided at reasonable <br />cost. <br />(f) Include a general explanation of the requirements for submission of <br />testimony and the procedure for conduct of hearings. <br />(g) State that copies of all evidence relied upon by the applicant are available <br />for review, and that copies can be obtained at cost. <br />(h) State that issues which may provide the basis for an appeal to the Land <br />Use Board of Appeals shall be raised in writing with sufficient specificity <br />to enable the decision maker to respond to the issue prior to the expiration <br />of the comment period. <br />(i) Include the name and telephone number of a city contact person. <br />(j) Briefly summarize the local decision making process for the decision <br />being made. <br />(3) For street name change applications, the city shall publish a notice in a local <br />newspaper with general circulation within the city at least one time during the <br />week immediately preceding the week of the city council hearing. The notice <br />shall state the time and place of the hearing, describe the nature of the <br />application, and inform the public of the opportunity to provide testimony. <br />Ordinance - 303 <br />
