9.7445 City Council Public Hearing Conduct and Procedures The city council shall <br />conduct a public hearing according to the quasi-judicial procedures in State law and <br />as set forth in EC 9.7065 through 9.7095, Quasi-Judicial Hearin s- Procedures. This <br />hearing is not a de novo hearing thus new evidence shall be allowed to be received. <br />910 - 7450 Decision. The city council shall male a decision within 30 days of the close of the <br />record, unless a longer time frame is agreed to by the person or entity initiating the <br />application. The city council may approve, modify and approve, or deny the Type N <br />application based on applicable approval criteria in this land use code. <br />9.7455 Notice of Decision <br />(1) Within 5 days of the decision, the city shall mail written notice of the decision <br />to all of the following: <br />(a) Applicant. <br />(b) Any person who has submitted written or oral testimony in a timely <br />manner during the city council hearing procedures. <br />(c) Any person who requested notice of the city council's decision. <br />(d) In the case of a refinement plan amendment, the Oregon Department of <br />Land Conservation and Development. <br />(2) The notice shall: <br />(a) Summarize the decision of the city council. <br />(b) Explain the appeal rights. <br />(c) In case of a notice being provided to the Oregon Department of Land <br />Conservation and Development, the notice shall also contain the text of <br />the amendment and findings, and it must specify any substantial changes <br />from the proposed text previously sent under EC 9.7440(1), state the date <br />of the decision, include a certificate of mailing containing a statement <br />signed by the person mailing the notice indicating the date the notice was <br />deposited in the mail, and list the place where and the time when the <br />adopted text maybe reviewed. <br />Type V Application Procedures <br />9.7500 General l Overview of Tune V Application Procedures. Type V applications <br />provide for a legislative review by the planning commission and city council of <br />changes to this land use code, amendments to refinement plans that include policies or <br />map changes that are broad in scope (not limited to a specific site), and adoption of or <br />an entire update to a refinement plan. The Type V process includes public notice and <br />a public hearing before the planning commission, which forwards a recommendation <br />to the city council. The city council holds a public hearing before making a final <br />decision. The city council's decision is based on compliance with the applicable <br />Ordinance - 304 <br />
