the hearing, city staff shall mail notice to the applicant, appellant, and persons <br />who requested notice of the planning commission decision or city council <br />hearing. <br />(3) Recision. Unless the applicant and appellant agree to a longer time period, the <br />city council shall make a decision within 15 days of the close of the hearing. <br />The city council may, by resolution, affirm, reverse, or modify the planning <br />commission's decision. When a decision is reversed or modified, the city <br />council shall make findings of fact, based on required criteria, as to why the <br />planning commission made an incorrect legal interpretation. <br />(4) Notice of Decision. <br />(a) Within 5 days of the decision, the city shall mail written notice of the <br />decision to all of the following: <br />1. Applicant. <br />2. Appellant. <br />3. Any person who requested notice of the city council decision. <br />(b) The notice shall: <br />1. Summarize the decision of the city council. <br />2. Explain the appeal rights. <br />9.7865 Consideration of Planning Commission Recommendation to Auurove <br />Application <br />(1) Public Hearing Schedule. The city council shall hold a hearing concerning the <br />planning commission recommendation in favor of an annexation and concurrent <br />change in zone, if necessary, within 60 days of the planning commission's <br />decision, unless the applicant agrees to a longer time period. <br />(2) Notice of Hearing. At least 10 days before the hearing, notice of the hearing <br />shall be mailed to the applicant, any person who has submitted written or oral <br />evidence or testimony in a timely manner in the planning commission <br />evidentiary hearing, and persons who requested notice of the planning <br />commission's decision. <br />(3) Decision. Unless the applicant agrees to a longer time period, within 15 days of <br />the hearing the city council shall by resolution, affirm, reverse, or modify the <br />PI anning commission's decision.
