In the event of inconsistencies between these plans and the Metro Plan, <br />the Metro Plan is the prevailing document. <br />(3) The uses and density that will be allowed by the proposed zone in the location <br />of the proposed change can be served through the orderly extension of key urban <br />facilities and services. <br />9.7845 Planning Commission Decision. Unless the applicant agrees to a postponement, <br />within 15 days following the close of the record, the planning commission shall deny <br />the application or recommend approval to the city council. A recommendation of <br />approval may include modifications to the original annexation application. If <br />necessary, the planning commission shall recommend approval, approval with <br />modifications, or denial of a concurrent change in zoning to the city council. A <br />decision to deny the application shall be supported by adopted findings and <br />conclusions based on EC 9.7835 criteria of Anroval for Annexations and if <br />applicable, EC 9.7840 Criteria of Approval for Changes in Zoning Concurrent with <br />Annexations_ <br />9.7850 Notice of Decision. <br />(1) A notice of the planning commission's decision shall be mailed within 5 days of <br />the decision to the applicant and persons who requested notice of the decision. <br />(2) The notice shall: <br />(a) Summarize the decision of the planning commission. <br />(b) Explain the appeal rights. <br />9.7855 Effective Date. Unless appealed, the planning commission's decision to deny an <br />annexation is final on the 11th day after notice of the decision is mailed. <br />9.7860 ADDeal of Plannine Commission Decision to Denv an Annexation ADplication. <br />(1) Application Filing. within 10 days of the date the planning commission's <br />decision to deny an annexation request is mailed, it may be appealed to the city <br />council by the owner, applicant, or any person who submitted written or oral <br />evidence or testimony for consideration in a timely manner during the planning <br />commission evidentiary hearing who is adversely affected by the decision. The <br />appeal shall be made by filing a statement of issues on appeal and other <br />information on a form approved by the city manager. The appeal shall be based <br />on the record, shall state specifically how the planning commission failed to <br />properly evaluate the proposed annexation or make a decision consistent with <br />the criteria for approval, and shall be limited to the issues raised at the <br />evidentiary hearing and set out in the filed statement of issues. City staff shall <br />provide the city council with the record. <br />(2) Public Hearing Schedule and Notice. Unless the applicant and appellant agree <br />to a longer time period, the city council shall hold a hearing to allow oral <br />argument on an appeal within 60 -days of its receipt.
