Obtaining Defense and Indemnification If an officen.employee, or agent receives notice of a tort claim or demand for which he/she may be entitled to defense or indemnity, that person shall file a written request for defense and indemnification through Risk Services. The request shall include: a. A brief statement explaining the substance of the claim b. Confirmation that he /she was acting within the course and scope of employment; C. Confirmation that the alleged act or omission did not involve malfeasance in office or willful or wanton neglect of duty; d. A statement that the request is being made under ORS 30.285 and 30.287.
