2. TESTING <br />Participation in the City of Eugene's drug and alcohol testing program is a requirement of each <br />covered employee. Safety - sensitive positions, or positions that require the performance of <br />safety - sensitive functions covered by Department of Transportation regulations; applicants for <br />employment; employees requesting transfer; and currently employed, covered employees are <br />required to submit to drug and alcohol testing, as mandated by Federal regulations and City <br />policy, as a condition of employment with the City of Eugene. DOT (Department of <br />Transportation) regulation 49 CFR Part 40, Procedures for Transportation Workplace Drug and <br />Alcohol Testing Programs, prescribes the testing method to be used, a copy of which is available <br />from the Designated Employer Representative (DER). <br />All drug and alcohol testing will be conducted in a manner that ensures a high degree of <br />accuracy and reliability by following prescribed techniques and chain of custody procedures and <br />utilizing equipment and laboratory facilities approved by the U.S. Department of Health and <br />Human Services (HHS) and DOT. To ensure test results are correctly attributed to the employee, <br />a unique chain of custody number is assigned to each specimen. The number is marked on both <br />the chain of custody form and the specimen bottle, which the employee checks at the time of <br />collection and verifies with his/her signature. The employee's name and chain of custody <br />number is verified at each step of the testing and reporting process. <br />All drug and alcohol testing will be conducted in an environment that affords maximum privacy <br />practicable for the covered employee being tested. The City of Eugene will adhere to all <br />standards of confidentiality, maintaining the confidentiality of the covered employee throughout <br />the drug and/or alcohol testing process, and releasing testing records and results only to those <br />authorized by FMCSA rules to receive such information. <br />Except as provided herein, the City of Eugene will be responsible for all costs directly associated <br />with the drug and alcohol test specified in this policy. <br />2.2.1 Pre- emplovment (382.301) <br />All applicants for employment in safety - sensitive positions covered by DOT <br />regulations, or individuals requesting to be transferred or promoted into safety - <br />sensitive positions covered by DOT regulations, must submit to and pass urine <br />testing for drugs prior to being hired or assigned to a safety - sensitive position. <br />Failure of a drug test will disqualify an applicant for employment in, or transfer to, a <br />safety - sensitive position.
