Post - accident drug testing must be performed within 32 hours. If the test cannot be <br />performed within 32 hours the test should not be given and the reason(s) why the test <br />could not be given within that time must be documented. <br />Other covered employees, whose performance could have contributed to the accident, <br />shall be tested as determined by the Program Manager or designee, using the best <br />information available at the time of the decision. The supervisor's decision - making <br />process to test or not to test will be documented and maintained as part of the <br />accident file. <br />If the covered employee to be tested was injured in the accident, the requirement to <br />test for drugs and alcohol should not delay necessary medical attention, but said <br />testing could possibly be administered simultaneously to the covered employee <br />receiving necessary medical attention. In order for testing to proceed, the injured <br />employee must be conscious and able to provide a urine sample in the normal way <br />he/she would if not injured. <br />The requirement to test for drugs and alcohol following an accident should in no way <br />delay necessary medical attention for injured people or prohibit a safety - sensitive <br />employee from leaving the scene of an accident to obtain assistance in responding to <br />the accident or to obtain necessary emergency medical care. <br />Any covered employee involved in an accident must remain readily available for <br />alcohol testing for up to eight (8) hours after the accident and should refrain from <br />using alcohol for eight hours following an accident or until the employee has <br />submitted to the required post accident tests (whichever comes first). Any covered <br />employee involved in an accident must remain readily available for drug testing for <br />up to 32 hours after the accident. The covered employee is responsible for notifying <br />his/her supervisor of his or her location if he or she leaves the scene of the accident <br />prior to submission to testing. Failure by the covered employee to remain readily <br />available may be determined to be a refusal to submit to testing. <br />When a covered employee has been notified that he/she will be required to submit to <br />post - accident drug and/or alcohol testing, he/she must report immediately to the <br />collection site designated by the City of Eugene. <br />2.2.4 Random (382,305) <br />All covered employees will be subject to random and unannounced drug and/or <br />alcohol testing. When a covered employee has been notified that he/she has been <br />selected for testing, he /she must report immediately to the collection site designated <br />by the City of Eugene. <br />The FMCSA or DOT set the testing rates for drugs and alcohol annually, and the <br />City will comply with those testing rates.
