B. An employee who has tested positive for drugs or alcohol will be required to sign <br />a performance agreement. A test that reveals the presence of over - the - counter <br />or prescribed drugs will not be considered positive unless the results indicate <br />misuse or abuse. Included in the performance agreement will be provisions for <br />unannounced testing for a one -year period following the positive test. If the <br />employee violates the terms of the agreement or again tests positive during such <br />a period, he or she shall be subject to immediate discipline, which may include <br />discharge. <br />Prescribed Drugs <br />It is the responsibility of an employee for whom drugs have 'sen prescribed to ask the <br />treating physician whether the use of the drug(s) may limitll I I'' pair the employee's <br />ability to perform employment related duties safely and effi gI. and what restrictions, <br />if any, should be followed and for how long. Any search of personal property or clothing will be <br />done with the consent of the employee. The search will be conducted in the employee's <br />presence without physical contact (i.e., the employee will be asked to empty pockets <br />and other personal belongings). Whenever possible, the search will be conducted by <br />the employee's supervisor and one other supervisor. All searches will be documented <br />and handled in a confidential manner. This provision is not intended to restrict the City's <br />right to conduct searches of assigned City property for other purposes or searches <br />related to any criminal investigation, as in the case of unlawful buying, selling, <br />transporting, possessing, or providing drugs. <br />
