Attachment A <br />P <br />JESOLUTION NO, 4908 <br />A RESOLUTION ESTABLISHING POLICY GOVERNING <br />CM TESTIMONT AND FUNDI REQUESTS, AND <br />REPEALING RESOLUTION* NO. 4139. <br />The City C ouncil of the City o Eugene finds that: <br />A, Under the Eugcne Charter it is the exclusive role of the City Council to sej <br />legislative poli for the City. <br />B. On September 13, 19$9 the City Council adopted Resolution ;�o. 4139 <br />cstablishing policy governing testimony and funding requesu by City representatives. <br />C. nc City Counc has determined that S ection 1 o f kesolution No, 4 139 should he <br />repealed. <br />D. The Coun finds that Resolution No. 4139 should be repealed in its entirety, and <br />its provisions, other than Secdoon 7, be readopted as hereinafter sot forth as City policy govcmi.ng <br />testimony before the Federal government, the Legislature Assembly of the Mate of Oregon or its <br />committees, Stato agcncirs, or municipal corporations, and submission of funding requests to <br />such cntitics. As used hcrcin, in addition to the Congress of the United Statcs, rcferenccs to <br />``Federal govcmment" includes all comminees, commissions, departrr nts, agencies, bureaus, <br />and b*ovcmrncnW divisions or instrumentalities of the United States_ <br />NOW, THEREFGRF� <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, <br />Municipal Cogwrstion of the State of Argon, as follows: <br />Brie d upon the above findings, which are adopted herein. Resolution Flo. <br />4139. adoptal by the Council on September 13, 1959, and any other Resolution in conflict <br />herewith is hereby repealed as of the cffe l'vc date of this Resolution, and City policy going <br />rtcstirnony and funding rrqucsts is cstablished as hcreirraftrr set forth. <br />Section 2. Any employee or agent of the City the Mayor or any member of the City <br />Council or wi City board or commission dcsiring to tcsti fir in his or her official capacity on <br />.legislative or regulatory matters Worc the State Legislative Assembly. 5tatc agencies, municipat <br />- :arporartions. or the Federal govemment, or desiring to submit funding requests for municipai <br />,activities thereto or to any private foundation, shall present the essence of the simony or <br />funding request to tie Council for prior approval, mod i fication, or di &approval_ <br />Section 3. No cmployc c, agent or officer of the City shall testify on legislative or <br />'regulatory mattes before a governmental entity or request funding from a public or private <br />source in his or her official capacity contrary to the adopted po licios of the Counci I.
