The waterways originally identified for protection were determined to <br />have a direct relationship to those that are on the State of Oregon's 303(d) list as water quality <br />impaired. <br />A public outreach process on the initial proposal was conducted including an open house where <br />affected property owners, interested persons, and the general public attended and provided <br />feedback. As a result of the issues raised, significant revisions were made to the proposal. The <br />revised proposal would apply protections only to the original waterways of concern that have no <br />existing protections under Goal 5 wildlife habitat regulations (Water Resources Conservation <br />Overlay Zone, referred to in Section 2.5.1). The revised proposal recognized the significant <br />incidental water quality protection already provided by the Goal 5/Water Resources Overlay <br />Zone, and became a proposal to "fill the gaps" in protection on a system of waterways that are <br />water quality impaired. <br />In March 2009, the Eugene City Council adopted the Water Quality Overlay Zone requirements, <br />the revised waterway protection proposal, and the adopted regulations became effective on June <br />10, 2009. Approximately 13.5 miles of waterways are protected by the Water Quality Overlay <br />Zone, including: 40 -foot setbacks on each side of certain headwater streams (measured from the <br />centerline of the waterway) and 25 -foot setbacks on each side of all other specifically identified <br />waterways (measured from the top of high bank). More specifically, the regulations: <br />Establish a Water Quality Overlay Zone and related water quality protection measures; <br />Apply the new zone to specifically identified lots within the Eugene city limits that <br />contain or are adjacent to waterways identified for protection on the Water Quality <br />Protected Waterways map; and <br />Identify certain properties outside the city limits (inside the urban growth boundary) that <br />contain or are adjacent to Water Quality Protected Waterways, and that will be rezoned to <br />apply the Water Quality Overlay Zone upon annexation to the City of Eugene if and <br />when annexation occurs. <br />Figure 4 -12 provides an overview of the City's waterway protections, and the specifically <br />identified Water Quality Protected Waterways.
