Attachment C - Application Materials <br />k A <br />CONSENT TO ANNEXATION FOR q, <br />UL (URBANIZABLE LAND) SUBDISTRICT. PROPERTIES <br />This 1s a Consent to Annexation by _ Mary Ayres Family, by _ <br />Mary Cr Treasurer (Owner) . <br />RECITALS: Owner represents the following: <br />1. Owner owns real property located outside the city limits of <br />the City of Eugene and within the Urban Growth Boundary of <br />the Eugene - Springfield Metropolitan Area General Plan (Metro <br />Plan). This tract (Property) is more particularly described <br />in Exhibit A, attached to this Consent. <br />2. The Urbanizat;le Land (UL) Zoning Subdistrict, described in <br />5 9,26B(f) of Lane County Ordinance No. 18 -86 (adopted <br />April 8, 1987) (Ordinance) has been applied to the Property. <br />3. By the terms of the Ordinance a Consent to Annexation is <br />required as a. precondition to allowance of a land use acti- <br />vity desired by Owner. <br />AWREEME Owner agrees as follows: <br />1. Owner irrevocably consents to annexation of the Property to <br />the City of Eugene. This Consent is given in consideration <br />_ for allowance by the City of Eugene of a land use activity <br />desired by Owner. <br />2. This Consent may be used by th3 City of Eugene or any other <br />person in initiating proceedings for annexation of territory <br />to the City of Eugene under ORS 199.490 or under any other <br />applicable law. Such annexation proceedings may be for <br />annexation of the Property or of the Property together with <br />other territory. <br />3. Owner agrees to execute a separate waiver of any time limita- <br />tion on this Consent to Annexation on a form approved by the <br />Cite of Eugene. <br />4. This Consent to Annexation is binding on Cwner and Owner's <br />heirn, assigns and successors and runs with the land. Notice <br />of this Consent may be recorded by the City of Eugene in the <br />records of the Lane County Recorder. <br />5.
