ECC UGENE ITY OUNCIL AIS GENDA TEM UMMARY Action: Approval of Minutes, Findings and Recommendations from the Hearings Official and Adoption of an Ordinance Levying Assessments for Improvements Consisting of Paving, Curbs and Gutters, Sidewalks, Landscape Medians, Street Lights, rdth Street Trees, Wastewater, and Storm Water Drainage on 3 and 4 Avenues between Pearl Street and Lincoln Street, North of Southern Pacific Railroad and South of Skinner Butte Park; and Providing an Immediate Effective Date (Contract 2006-04) (Job #3827) Meeting Date: May 8, 2006 Agenda Item Number: 4 Department: Public Works-Engineering Staff Contact: Paul Klope www.eugene-or.gov Contact Telephone Number: 682-5246 ISSUE STATEMENT City Council is being asked to approve the Hearing Official’s Minutes, Findings and Recommendations dated April 19, 2006, and adopt an ordinance levying assessments for improvements consisting of paving, curbs and gutters, sidewalks, landscape medians, street lights, street trees, wastewater and storm rdth water drainage on 3 and 4 avenues between Pearl Street and Lincoln Street, north of the Southern Pacific Railroad and south of Skinner Butte park. Please note: This item has an immediate effective date. An immediate effective date requires a 2/3 majority or six affirmative votes from the council to enact. Ordinances without an immediate effective date do not take effect for 30 days. Without an immediate effective date, an additional 30 days of interest expense will accrue. BACKGROUND This project was identified in the FY04-FY09 Capital Improvement Program (CIP) adopted by the council on February 24, 2003, and pursuant to Section 7.160(5) of the Eugene, Code, 1971, a Local Improvement District (LID) was initiated. The North End Scoping Study was used as a guide for design and connections between the train station and Skinners Butte and the Shelton-McMurphey- Johnson House. Bids were opened on June 16, 2005, with Babb Construction Co. dba Delta Construction Co. as the low bidder. Property owners were notified of the public hearing regarding formation of the proposed LID and the public hearing was held on June 20, 2005. The City Council passed a resolution forming the LID on July 18, 2005. Construction of the project has been completed, final actual costs have been tabulated, and final assessment costs have been calculated Based on the low bid received, the costs listed below are the estimated assessment costs calculated at the time of the formation of the LID.
