<br />ATTACHMENT A <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE CONCERNING THE CHANGE OF STREET <br />NAME OF THE 3rd/4th CONNECTOR WHICH EXTENDS <br />EAST FROM LINCOLN STREET TO PEARL STREET <br />WITHIN THE CITY OF EUGENE, TO SHEL TON <br />McMURPHEY BOULEVARD. <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. On December 12,2005, the City Council passed a motion by a unanimous vote to <br />initiate the processing of a street name change application to change the name of the 3rd/4th <br />Connector, also known as 3rd/4th Avenue, to Shelton Boulevard. <br /> <br />B. ORS 227.120 and Eugene Code (EC) Sections 9.8475 through 9.8490 set forth the <br />procedures for considering a street name change, which includes a Type IV review process requiring <br />the Planning Commission to hold a public hearing according to the quasi-judicial procedures of state <br />law and those set out in EC 9.7065 through 9.7095, and to make a recommendation to the City <br />Council to approve, approve with modifications, or deny the application. <br /> <br />C. On February 10,2006, notice of a public hearing to be held by the Eugene Planning <br />Commission was mailed to property owners and occupants within 300 feet of the 3rd/4th Connector, <br />to the Whiteaker Community Council, the affected Eugene neighborhood association, and to persons <br />who requested notice. Notice was also posted and freestanding signs were installed pursuant to EC <br />9.7415. <br /> <br />D. On March 14, 2006, the Eugene Planning Commission held a public hearing on the <br />proposed street name change, and following the public hearing, the Planning Commission <br />unanimously recommended that the City Council change the name of the 3rd/4th Connector to Shelton <br />McMurphey Boulevard. The Planning Commission recommended against the use of Shelton <br />Boulevard as a street name. <br /> <br />E. On April 21, 2006 notice of the City Council public hearing on the proposed <br />ordinance was mailed to all parties who submitted written or oral testimony and to parties who <br />requested notice of the Planning Commission decision, pursuant to EC 9.7440. On April 23, 2006 <br />notice of City Council public hearing was published in the Register-Guard as required by Section 28 <br />of the Eugene Charter of2002, and On May 1,2006, notice of the City Council public hearing on the <br />proposed ordinance was published in the Register Guard, as required by EC 9.7440(3). <br /> <br />F. On May 8, 2006, the City Council held a public hearing on the proposed street name <br />change, and is now ready to take action. <br /> <br />Ordinance - 1 <br />
