Your spoken testimony will be recorded <br />in the minutes of the hearing. <br /> <br />All written materials that have been submitted to the Planning Commission concerning this matter <br />have been forwarded to the City Council. <br /> <br />Testimony and evidence of those testifying should be directed toward the applicable criteria described <br />above, or other criteria in the applicable plan or land use regulation that the person testifying believes <br />apply to the decision. The applicable refinement plan for this area is the Whiteaker Plan. <br /> <br />You may also state your opinion to your neighborhood group. This application primarily affects <br />residents of the Downtown Neighborhood Association and the Whiteaker Community Council <br />neighborhood group. To contact the neighborhood groups, call the Neighborhood Liaison Office at <br />682-5009 or visit the website at: www.eugene-or.gov <br /> <br />Conduct of the Public Hearin2 <br />The general order of the hearing is ~s follows (it is council policy to limit the time allowed for people <br />providing oral testimony to 3 minutes): <br />1. Eugene Mayor will commence the public hearing. <br />2. The Mayor will ask Councilors to disclose any conflicts of interest, ex parte contacts, <br />and biases, abstentions or challenges to impartiality submitted pursuant to EC 9.7065. <br />3. Council will receive a City staff report and Councilors will share any information <br />learned from site visits. <br />4. Public testimony from the applicant and others in support of the application. <br />5. Comments or questions from interested people who are neutral. <br />6. Public testimony from those in opposition to the application. <br />7. Staff response to testimony. <br />8. Rebuttal by the applicant. <br />9. Mayor will announce whether the record is closed; record will be held open; or the <br />public hearing will be continued. <br /> <br />The City of Eugene complies with state and federal laws and regulations Pertaining to discrimination, <br />including Americans with Disabilities Act of 1990 (ADA). The ordinance and all other documents and evidence, the applicable criteria are <br />available for free inspection at the Eugene Planning and Development Department, First Floor <br />Reception, 99 West 10th Avenue, Eugene, Oregon, between 1 :00 p.m. and 5:00 p.m. Copies may be <br />obtained at a reasonable cost. The Planning Division staff report to the City Council will be <br />available by 3:00 p.m. on Monday, May 1, 2006, at the same location.
