<br />~ <br /> <br />Home Builders <br /> <br />ASSOCIATION <br />of Lane County <br /> <br />Mayor Piercy <br />Eugene City Council <br />City of Eugene <br />777 Pearl Street <br />Eugene, Oregon 98401 <br /> <br />;' <br /> <br />~ Cf!fCe-lflJ!' <br />, y ~Jl <.70 <br />~H J 'lN4G8 <br />/ 2006 li <br /> <br />April 17, 2006 <br /> <br />Dear Mayor Piercy and Councilors: <br /> <br />The Home Builders Association of Lane County appreciates the opportunity to submit written <br />comments on the proposed PROS Priority Plan and Project List and thanks the council for <br />keeping the record open for an additional week. <br /> <br />Our comments fall into two broad categories: (1) Our issues with the Growth Allocation, as <br />well as a proposed solution; and (2) A recommendation for additional neighborhood parks to <br />be added to the project list. <br /> <br />GROWTH ALLOCATION COMMENTS AND SOLUTION <br /> <br />All of us recognize that issues related to system development charges (SDCs) are often <br />complicated. The examination of the proposed Growth Allocations on the proposed project <br />list is no exception. Nevertheless, it is important that the council give its attention to the <br />matter, and I will try to keep the explanation of our concerns as transparent as possible. It <br />may be advisable, therefore, to provide a brief description of what the growth allocation is and <br />some rules that pertain to it. <br /> <br />SDCs are established and governed by state statutes ORS 223.297 to ORS 233.314. ORS <br />223.309(1) establishes the need for a project list, as well as additional information: <br /> <br />Prior to the establishment of a system development charge by ordinance or resolution, a <br />local government shall prepare a capital improvement plan, public facilities plan, master <br />plan, or comparable plan that includes a list of the capital improvements that the local <br />govemment intends to fund, in whole or in part, with revenues from an improvement fee <br />and the estimated cost timing, and percentages of costs eligible to be funded with <br />revenues from the improvement fee for each improvement (emphasis added). <br /> <br />(~-"... <br />, ' <br />.,,~/ <br /> <br />2053 Laura Street Springfield, OR 97477 (541) 484-5352 FAX: (541) 484-5386 <br />
