EWEB DOWNTOWN RIVERFRONT <br />LAND USE COMPONENTS <br /> <br />(t) EC 9.4815 /WB Wetland Buffer Overlay Zone Siting Requirements. <br />(u) An uncodified ordinance establishing a site specific S-H Historic Special Area Zone, a <br />copy of which is maintained at the city’s planning and development department. <br />The S-DR Downtown Riverfront Special Area Zone is being established in the land use code as part <br />of the implementation of the redevelopment vision. Approval of the zone change is dependent upon <br />the approval of these code amendments. The proposed code amendments add S-DR siting <br />requirements and renumber EC 9.8865(4)(j) through (v) accordingly, as included in Exhibit C Code <br />Amendments. <br />The proposed S-DR Zone (Exhibit B S-DR Downtown Riverfront Special Area Zone) includes siting <br />requirements, which require, in addition to the approval criteria of EC 9.8865, that the site to be <br />rezoned must be included within the Downtown Riverfront area depicted on Figure 9.3135(1) of the <br />proposed S-DR Zone. The siting requirements of the S-DR Zone under EC 9.3140 also state when <br />a property is rezoned as part of the rezoning process, the City shall identify the plan sub-district <br />designation applicable to the property, in accordance with EC 9.3135 plan sub-districts. The <br />proposed S-DR Zone regulatory plan, as depicted on Figure 9.3135(1), includes two sub-districts; <br />mixed-use and cultural landscape and open space. <br />Regarding the removal of the /TD Overlay Zone from twelve (12) parcels and the retention of the <br />/WR overlay zone on nine (9) parcels, there are no siting requirements related to the /TD Overlay <br />Zone and the /WR Overlay Zone siting requirements only apply for the purposes of adding the <br />overlay zone. Based on the above findings, the proposed zone change is consistent with the <br />criterion. <br />(5) In cases where the NR zone is applied based on EC 9.2510(3), the property owner shall enter <br />into a contractual arrangement with the city to ensure the area is maintained as a natural <br />resource area for a minimum of 50 years. <br />The proposal does not involve the application of the /NR Zone.
