<br /> Ms. Heintz said citizens also were not permitted to vote on sewers in the <br /> River Road area. She said development of the River Road/Santa Clara Urban <br />e Facilities Plan by the CAT excluded participation of the River Road Community <br /> Organization. She said the community organization opposes the annexation <br /> proposals within and without the organization's boundaries recognized by the <br /> Lane County Board of Commissioners. She specifically opposed the annexation <br /> of Beltline Road. She di scussed State legislation concerning annexation <br /> procedures. <br /> Ms. Heintz said the River Road Community Organization opposes all annexation <br /> proposals in the area. She requested that her testimony be included in the <br /> record of each proposal. <br /> There being no more requests to testify, Mayor Obie closed the public hearing. <br /> Ms. Brody said the zoning on Tax Lot 100 may have been changed by error but the <br /> current zoning is commercial. The staff considered that and the impact of the <br /> River Road widening when evaluating zoning for Tax Lot 200 and decided that <br /> commercial zoning would be appropriate. She said the owner of Tax Lot 200 <br /> does not want the property annexed if it is not rezoned for commercial use. <br /> Ms. Brody said both the previous offi cers of the River Road Community <br /> Organization and those represented by Ms. Hei ntz were notified of the <br /> council's public hearing. Abutting property owners were also notified of the <br /> hearing and the staff held an informational meeting in the neighborhood before <br /> the Planning Commission hearing. <br /> Mr. Holmer read from minutes of an April 1986 council meeting in which <br />e Mr. Miller urged council officials to bring the streets in the River Road area <br /> up to City standards so property owners would not be assessed for upgrading <br /> the streets after annexation. Answering questions from Mr. Holmer, City <br /> Engineer Les Lyle said Lane County officials will pay for improving River Road <br /> and neither abutting property owners nor the City will pay for it. The City i s <br /> still negotiating with County officials about what condition the streets will <br /> be left in after the sewer construction. The roads probably wi 11 not be <br /> brought up to City standards but the City will take over their maintenance. <br /> Mr. Whitlow said streets that are annexed will be included in future urban <br /> transition payments to the City from the County. <br /> Replying to questions from Ms. Wooten, Ms. Brody said Mr. Chapman referred to <br /> the planning process for the River Road Urban Facilities Plan and indicated <br /> that rezoning Tax Lot 200 would not be legal because it would not conform to <br /> the policy in the plan that indicates existing land use patterns should be <br /> maintained until the River Road/Railroad Avenue subarea is studied. Ms. Brody <br /> said the recommendation to rezone Tax Lot 200 is the result of an evaluation <br /> of the impact of the River Road widening and the Chambers Connector and, <br /> therefore, complies with the plan. <br /> Answering a question from Ms. Bascom, Mr. Lyle said sanitary sewers have been <br /> constructed in the area. <br />e MINUTES--Eugene City Council October 26, 1987 Page 3 <br />
