Responding to a question regarding the maintenance of the <br /> paths, Ms. Bishop said there was an agreement between the Parks and Public <br /> Works departments to maintain the surfaces and edging of the paths. <br /> Res. No. 3938--A resolution approving amendments to the Bikeways <br /> Master Plan. <br /> Ms. Wooten moved, seconded by Mr. Holmer, to adopt the <br /> resolution. Roll call vote; the motion carried unanimously, 5:0. <br /> III. NUISANCE ABATEMENT FOR 938 JEFFERSON STREET (memo distributed) <br /> Assistant City Manager David Whitlow introduced the agenda item. Public Works <br /> Maintenance Engineer Bill Guenz1er presented the staff report, reviewing the <br /> August 9, 1985, memorandum from Building Official Larry Reed to the City <br /> Council and the notice sent to Gordon Elliott directing him to abate the <br /> nuisance at 938 Jefferson Street. Mr. Guenz1er stated that the nuisance had <br /> not been abated as of August 8, at which time staff directed the issue to the <br /> City Council. He said staff had taken bids for abatement of the nuisance and <br /> staff would be discussing with the City Attorney some complications involved <br /> with the bi ds. He also sta ted tha t sta ff ha d di scussed the issue wi th <br /> Mr. Elliott on August 12 who had stated he was attempting to clear the site. <br /> Mr. Guenz1er said that the efforts being taken by Mr. Elliott were not <br />e sufficient and told Mr. Elliot that the City would proceed with the abatement <br /> if authorized by the City Council. <br /> In response to a question by Councilor Ehrman, Mr. Guenzler said that the <br /> present abatement procedure was the only one in which the fire was so complete <br /> as to warrant the City's immediate action. He said the other buildings <br /> involved in the recent fires would be addressed by staff. In response to a <br /> question regarding the bid amount, he said the only complete bid received was <br /> in the amount of $5,800. <br /> Councilor Ehrman commented that it was a sad situation that Mr. Elliot's home <br /> had been destroyed, but she said the major concern was for public safety. <br /> She felt the City Council should act but should act consistently in addressing <br /> the various houses which had been burned. <br /> Mayor Obie stated that the agenda item had not been scheduled for public <br /> hearing but that he would allow for testimony due to the delicate nature of <br /> the situa ti on. <br /> Gordon Elliott, 938 Jefferson Street, stated that he wanted to make the best <br /> use of the property. He reported that he has attempted to negotiate with <br /> numerous people to assist in the clean-up so as to allow him to salvage some <br /> of the materials on the property.
