options that would allow for the sale of the Annex with continuation of the senior center <br /> activities at the KaUfinan House. One of the options was to pursue a City Historic Landmark <br /> designation for both properties, and a subsequent establishment of a S-H Historic Special Area <br /> Zone for the Kaufman House, with uses and development standards appropriate for the site. This <br /> option was selected by Facilities staff as the best way to preserve the historic structures and <br /> gardens while'allowing for a range of uses that would be compatible within the surrounding <br /> neighborhood context, regardless of ownershiP. In this scenario, the conditional me permit <br /> binding the two properties will be revoked, the Annex will convert to a use consistent with the <br /> existing R-2 Medium Density Residential zoning, and the existing senior center may continue to <br /> operate at the Kaufman Home as an outfight permitted me. <br /> <br /> In .December 2003, both properties were designated as Historic Landmarks by the Eugene <br /> Historic Review Board. The Kaufman Senior Center is now officially known as the Gertrude <br /> and Ludwig Kaufman House, and the Kaufman Annex is now the Grant and Maude Beardsley <br /> Home, both named after their long time owners. In the case of the Kaufman House, both the <br /> historic structures and landscape are identified as significant historic-features meriting protection. <br /> The three land me actions under consideration by the Planning Commission are specific to the <br /> Kaufman Home. . . <br /> <br />PROCEDURAL REQUIREMENTS & PLANNING COMMISSION REVIEW ROLE: <br />The Eugene Code (EC) requires that the establishment of a Special Area Zone and the concurrent <br />code amendment and zone change applications be processed according to the Type V provisions <br />designed for legislative actions. Given the sit'e-speCific nature of the proposed zone, the <br />minimum requirements for quasi-jddicial action at ORS 197.763 must also be met. As such, the <br />proposed actions will be processed in accordance with both the TyPe V Application Procedures <br />designed for quasi-judicial actions beginning at EC 9.7500 and the Type IV procedures <br />beginning at EC 9.7400. <br /> <br />The Eugene City Council initiated the process for establishment of a S-HK zone and code <br />amendment at their May 24t~ meeting, in aeeoxdance with Type V application procedures at the <br />request of Facilities staff. Planning staff provided public hearing notice and has otherwise <br />processed the proposed landuse actions consistent with Type IV and Type V requirements. To <br />. date, Planning staff has responded to inquires in response to the public notice, but has not- <br />received written comments. <br /> <br />In accordance with applicable requirements, the Planning Commission is scheduled to conduct a <br />'public hearing according to the quasi-judicial procedures of State law and those set out in EC <br />9.7065 to 9.7095. Within 30 days of the close of the public record, the Planning Commission shall <br />recommend to the City Council approval, approval with modifications, or denial of the <br />applications based on applicable approval criteria. The Planning Commission is asked to <br />deliberate and forward their recommendation immediately following the public hearing on October <br />26, 2004 to enable City Council consideration prior to their December break. The City Council <br />public hearing is tentatively scheduled for November 22nd, with final action to take place on <br />December 6 , the last City Council meeting prior to the break.
