(the draft ordinance establishing the zone is provided in Attachment A-l). As required, the <br />proposed Kaufman House Special Area Zone details the purpose of the zone, siting requirements, <br />land use and permit requirements, development standards, lot standards, and adjustment review <br />criteria. The S-HK Zone describes the historic status of the landmark property and acknowledges <br />that both the Kaufman House structures and landscape, are significant historic features subject to <br />historic property alteration requirements (refer to Attachment A-2 for Historic Property Alteration <br />approval criteria). Future use of the Kaufman House Will be subject to land use code and building <br />code requirements in addition to the provisions set out in the s.HK Zone. The practical effect of <br />such requirements, and in particular historic property alteration and parking 'requirements, is that <br />future use of the Kaufman House site Will be adaptive and, as a result,.limited in intensity. <br /> <br />The uses listed in the S-HK Zone have been selected With consideration to compatibility With the <br />surrounding neighborhood, significant historic features of the site, the policy direction found in the <br />Metro Plan and Westside Neighborhood Plan.. and the feasibility of the use Within the existing <br />structures given land use code and building code requirements' The existing senior center falls <br />~within the "Community and Neighborhood Center" category identified in the use table, and is <br />permitted outright as a legally conforming use. In addition to Community and Neighborhood <br />Center uses, the proposed s-HK Zone allows select residential, educational and cultural, office, <br />neighborhood commercial and accessory uses. Most of the uses listed are permitted outright, With <br />recognition that historic property alteration review requirements significantly constrain the ability <br />to alt. er the structures or landscape for additional development or uses With greater, parking <br />reqmrements. Conditional use permit approval is proposed in those cases where the conditional <br />use permit approval criteria may afford a greater assUrance of compatibility With the surrourt, ding <br />neighborhood than afforded by the historic property alteration review criteria.' <br /> <br />TheEugene Code provides that before adopting an ordinance establiShing a S Special Area Zone, <br />the City Council shall find that the proposal is in compliance with following criteria from EC <br />9.3020: <br /> <br /> (1) The area to which the S Special Area Zone is being applied meets at least one of the <br /> folloWing criteria: <br /> (a) Is identified in the Metro Plan or a refinement plan as appropriate for nodal <br /> development, or for a special range of uses or development that can best be achieved <br /> with the use of a special area zone; or <br /> (b) Possesses distinctive buildings or natural features that require special consideration <br /> to ensure appropriate development, preservation, or rehabilitation. In order to be <br /> considered distinctive, it must be demonstrated that: <br /> 1. The area is characterized by buildings that merit preservation in order to protect <br /> their special features; or <br /> 2. The area contains natural features that have been identified by the city as worthy <br /> of special treatment or preservation. <br /> <br /> (2) An analysis of the area demonstrates how the uses and development standards of the S <br /> Special Area zone ordinance will facilitate implementation of the planned use of the <br /> property or the preservation or rehabilitation of distinctive buildings or natural features <br /> of benefit to the community. <br /> <br /> (3) Except for areas zoned S-H Historic Special Areazone, the area to be classified S <br /> Special Area includes at least ~ acre in area. <br /> <br /> 3 3 <br /> <br /> <br />
