codeamendmentsandzonechanges,thetrafficgeneratedfromeachofthesubjectproperties <br />aftertheamendmentscannotexceedtrafficthatcouldbegeneratedbyusesthatarealready <br />allowedunderthecurrentzoning.Thetripcapisanenforceable,ongoingrequirementthatwill <br />demonstrablylimittrafficgenerationforthesubjectpropertiesbypreventingthetraffic <br />generationbeyondcurrentlyallowedlevels.Thetripcapisenforceableandongoingbecauseit <br />willbemonitoredforthesubjectpropertieseachtimeabuildingpermitisreceivedbytheCity. <br />Untilthecapislifted,eachofthepropertieswithinthesubjectareacanonlydevelopwithause <br />thatgeneratesthesameorlesstripsthancouldhavebeengeneratedundertheprevious <br />zoning. <br />Thetripcapandthemannerinwhichitcanbemodifiedwillberecordedwiththerezoning <br />ordinanceadoptingthezonechanges.Thus,inaccordancewithOAR6600120060(1)(c),the <br />proposedtripcapcanbeconsideredwhendeterminingwhetheraproposedamendmentwill <br />significantlyaffectanexistingorplannedtransportationfacility.Becauseimposingatripcapof <br />4960preventstheproposedamendmentsandzonechangesfromcreatinganyadditionaltraffic <br />generationfromthesubjectproperties,thetripcapcompletelyeliminatesthepotential <br />significanteffectoftheamendmentsandzonechangesand,therefore,noadditionalTPR <br />analysisisneeded. <br />Withatripcapthatpreventstripgenerationbeyondcurrentlyallowedlevelstheproposed <br />amendmentcomplieswiththeTPR;anymodificationorliftingofthetripcaprequiresa <br />separatedemonstrationofTPRcompliance.Thus,priortomodifyingorliftingofthetripcap,an <br />analysismustbedonetodeterminewhether,withoutthetripcaporwithamodifiedtripcap, <br />anyexistingorplannedtransportationfacilitieswillbesignificantlyaffectedbythe <br />amendments.Iftheanalysisshowsthatthereisasignificanteffectfromtheamendments,the <br />tripcapcouldbeliftedormodifiedonlyifoneormoreofthemitigationmeasuressetforthin <br />OAR6600120060(2)isadopted.Thisanalysisand,ifnecessary,adoptionofmitigation <br />theŝƚLJ͛ƐupdatetoitsTransportationSystemPlan(TSP)or <br />measures,couldoccuraspartof <br />couldoccurthroughaseparateprocess.WhetherdonethroughtheTSPadoptionprocessora <br />separateapplication,thetripcapmodificationprocesswillincludenoticeandanopportunity <br />forpublicparticipationandademonstrationofcompliancewiththeTPR. <br />Assuch,perOAR6600120060(3)thepotentialsignificanteffectofthecodeamendmentsand <br />zonechangesonexistingandplannedtransportationfacilitieswithintheWestEugenestudy <br />areaiseliminatedbecausetheamendmentsandcodechangesincludeatripcapthatisan <br />enforceable,ongoingrequirementthatlimitstrafficgenerationtocurrentlyallowedlevels; <br />thereforetheproposedcodeamendmentsandzonechangesareconsistentwithGoal12. <br />CampusIndustrialAreas <br />ThecampusindustrialareasarezonedI1(CampusIndustrial;seemapsinAttachmentsB,C, <br />andD).ThiszoneisproposedtoberenamedE1CampusEmploymentandtheuselistrevised <br />toincludemoreofficeandmedicaluses.Foreachofthethreecampusindustrialareasthe <br />analysiscomparedreasonableworstcasescenariotrafficgenerationundertheexistingI1 <br />zoningtoreasonableworstcasescenariotrafficgenerationundertheproposedE1zoning.The <br />Findings6 <br />
