willnotresultinanyoftheeffectsdescribedin(1)(c)(A)(B)aboveandnofurtheranalysisis <br />needed. <br />ZoneChanges <br />TheentireCrowRoadStudyAreaiscurrentlyzonedR1lowdensityresidential.Theproposal <br />istokeepaboutthreequartersofthestudyareaasR1andrezonetheacreagethatis <br />remainingdesignatedasmediumdensityresidentialtoacorrespondingR2mediumdensity <br />residentialzone(seetable). <br />StudyAreazoneExistingacresProposedacres <br />CrowRoadR290.6 <br />StudyArea <br />R1262171.2 <br />OAR6600120060(9)providesanexceptiontodeterminingifazonechangewouldhavea <br />significanteffectonanexistingorplannedtransportationfacility: <br />(9)Notwithstandingsection(1)ofthisrule,alocalgovernmentmayfindthatan <br />amendmenttoazoningmapdoesnotsignificantlyaffectanexistingorplanned <br />transportationfacilityifallofthefollowingrequirementsaremet. <br />(a)Theproposedzoningisconsistentwiththeexistingcomprehensiveplanmap <br />designationandtheamendmentdoesnotchangethecomprehensiveplanmap; <br />(b)ThelocalgovernmenthasanacknowledgedTSPandtheproposedzoningis <br />consistentwiththeTSP;and <br />(c)Theareasubjecttothezoningmapamendmentwasnotexemptedfromthis <br />ruleatthetimeofanurbangrowthboundaryamendmentaspermittedinOAR <br />660024020(1)(d),ortheareawasexemptedfromthisrulebutthelocal <br />governmenthasasubsequentlyacknowledgedTSPamendmentthataccounted <br />forurbanizationofthearea. <br />TheproposedrezonetoR2satisfiesOAR6600120060(9)(ac)asfollows.Regarding <br />subsection(a),asdiscussedabove,thesubjectpropertiesproposedforrezoningtoR2are <br />map.R2 <br />designatedasmediumdensityresidentialontheŝƚLJ͛Ɛadoptedcomprehensiveplan <br />zoningisconsistentwiththecurrentmediumdensityresidentialcomprehensiveplanmap <br />designationformediumdensityresidentialuses;thereforetheproposedzonechangeis <br />consistentwithsubsection(a). <br />Regardingsubsection(b),TransPlanistheŝƚLJ͛ƐadoptedandacknowledgedTransportation <br />SystemPlan(TSP).Thecurrentcomprehensiveplanmapwasinplacein2001,theyearthat <br />theCityCounciladoptedTransPlan.Thesubjectpropertiesweredesignatedmediumdensity <br />residentialbothbeforeandsincetheCityCounciladoptedthe2001TransPlan.Inadopting <br />TransPlan,theCityCouncilfoundTransPlantobeconsistentwiththeMetroPlanwhich <br />includestheMetroPlandiagram.Additionally,TransPlandoesnotincludeanythingthatis <br />inconsistentwiththesubjectpropertiesbeingzonedR2.BecausetheR2zoningwillnot <br />change(isconsistentwith)theƉƌŽƉĞƌƚŝĞƐ͛comprehensiveplandesignationofmediumdensity <br />residential,andTransPlanisconsistentwiththemediumdensityresidentialdesignation,aR2 <br />zoneonthesubjectpropertiesisconsistentwiththeŝƚLJ͛ƐacknowledgedTSP,andassuchis <br />consistentwithsubjection(b).Consistentwithsubsection(c),theareawasnotexempted <br />fromthisruleatthetimeofaUGBamendment. <br />Findings11 <br />
