<br />Sustainability Commission <br />There are 13 positions on the new Sustainability Commission; of these four are to be appointed at <br />large by the City Council, eight are to be selected by each individual City Councilor and the <br />Mayor is to appoint one member of the City Council. The four at-large positions are to be <br />selected first by the City Council; then, by October 26, 2007, the individual selections are to be <br />made. As per the ordinance creating the Sustainability Commission, the four at-large <br />appointments are to initially serve two-year terms. There were 73 applications received for the <br />Sustainability Commission. The balloting (see Attachment A) did not provide any candidate who <br />received five or more votes to thus have his or her name placed in nomination. <br /> <br />Several of the applicants for the Sustainability Commission do not reside within the Eugene Urban <br />Growth Boundary. The Eugene Code 2.013 (6) states: <br />“In nominating or making appointments, the council, mayor, or city manager or designee shall <br />take into consideration information provided by the citizen interest form, and shall nominate <br />or appoint only those persons who at the time of appointment, reside within the city's urban <br />growth boundary. If during their term a member ceases to reside or work, if applicable, <br />within the city's urban growth boundary, the position shall be vacated, effective as of the date <br />a qualified resident from within the city's urban growth boundary willing to serve is appointed <br />to fill the position. The council may waive the residency requirement if the council deems it to <br />be in the best interest of the committee purpose and function.” <br /> <br />The City Attorney has advised that if the City Council wishes to appoint persons to the <br />Sustainability Commission who do not reside within the Eugene UGB, a motion affirming that <br />intend should be adopted by the council. If this is the desire, the motion is listed below. <br /> <br />Move to waive the Eugene Urban Growth Boundary residency requirement for applicants <br />applying and appointed to the Sustainability Commission. <br /> <br />Move to appoint ___________ to Position 1 on the Sustainability Commission for a two-year <br />term beginning November 1, 2007, and ending on October 31, 2009. <br /> <br />Move to appoint ___________ to Position 2 on the Sustainability Commission for a two-year <br />term beginning November 1, 2007, and ending on October 31, 2009. <br /> <br />Move to appoint ___________ to Position 3 on the Sustainability Commission for a two-year <br />beginning November 1, 2007, and ending on October 31, 2009. <br /> <br />Move to appoint ___________ to Position 4 on the Sustainability Commission for a two-year <br />term beginning November 1, 2007, and ending on October 31, 2009. <br /> <br />Toxics Board <br />There are two vacancies on the Toxics Board. One is for a “right-to-know advocate” position <br />and one is a “business required to report” position.
