<br />With regard to OAR 660-012-0060(1)(c)(C), the analysis determined that two facilities within <br />the scope of the study are otherwise projected to operate below the performance standard in the <br />plan year. These facilities are: <br /> <br />· River Road at Green Lane intersection <br />· River Road at Hunsaker Lane and Irving Road intersection. <br /> <br />The commenting agencies determined that the proposal's contribution to the projected '''F'' Level <br />of Service at the River Road at Green Lane intersection is negligible, not worsening the <br />performance. Therefore under this definition, the proposal does not significantly affect that <br />facility. By a small margin, the proposal worsens the perfomlance of the River Road at Hunsaker <br />Lane and Irving Road intersection in the plan year. Therefore, it significantly affects that facility <br />under this definition. <br /> <br />OAR 660-012-0060(3) permits local governments to approve a PAPA that significantly affects a <br />facility without requiring that mitigations bring the facility up to the applicable perfom1ance <br />standards. This is allowed only where the facility is currently operating below the perfomlance <br />standard and, despite any planned facilities as defined in Section (4) of the TPR, it is also <br />projected to operate below the perfomlance standard in the plan year. Taking into account all <br />planned facilities, the TIA demonstrates that these conditions are met at the River Road at <br />Hunsaker Lane and Irving Road intersection. OAR 660-012-0060(3)(c) requires transportation <br />improvements that mitigate the net impact and avoid further degradation in the development <br />(opening) year. The TfA used 2008 as the development year in this analysis. The impact analysis <br />shows that even without mitigation there is no measurable development year degradation of the <br />facility. Therefore, no mitigation is needed to meet the requirements of OAR 660-012- <br />0060(3)(c). <br /> <br />Proposed Improvements: <br />The TIA has shown that the Proposed PAPA significantly affects only one facility in the plan <br />year and that the eUcct in the development year is so minute, the requirements of the TPR can be <br />met without mitigation. Nonetheless, the applicant and commenting agencies have informally <br />agreed that certain improvements to the existing facilities are desired. Because these <br />improvements wilt be specified in conditions of approval for the proposed PAP A, the proposal <br />must be reevaluated as conditioned. The planned improvements are offered as "minor <br />transportation improvements" as defined OAR 660-0121-0005(15) and pursuant to OAR 660- <br />012-0060(2)( e). These improvements are: <br /> <br />. Construct an additional Hunsaker Lane westbound approach lane <br />. Construct an additional Green Lane westbound approach lane. <br /> <br />With the proposed improvements specified as conditions of development, the TIA has <br />determined that, measured at the end of the planning period, the proposed amendment will <br />neither reduce the performance of existing or planned transportation facilities below the <br />minimum acceptable performance standards identified in TransPlan, nor worsen the <br />perfomlaI1Ce of transportation facilities that are othef\vise projected to perform below the <br /> <br />Santa Clara - Metro Plan Amendment Application <br />Written Statement - August 2,2007 <br /> <br />Page 19 of32 <br />
