APPLICABLE CRITERIA AND FINDINGS <br /> <br />Eugene Code Section EC 9.8424 requires an evaluation of any retlnement plan amendment to <br />determine whether the anlendmel1t is consistent with the following criteria. Criteria are shovvTI in <br />bold and italics text. <br /> <br />EC 9.8424 Refinement Plan Amendment Approval Criteria. The planning commission shall <br />evaluate proposed refinement plan amendments based on the criteria set forth below, and <br />forward a recommendation to the city council. The city council shall decide whether to act on <br />the application. If the city cOllltcil decides to act, it shall approve, approve with modifications <br />or deny a proposed refinement plan amendment. Approval, or approval with modifications <br />shall be based OIt compliance with the following criteria: <br /> <br />(1): Tlte refinement plall amendment is consistent with all of tlte following: <br />(aj Statewide planning goals. <br /> <br />Goal 1 - Citizen Involvement: To develop a citizen involvement program that insures the <br />opportunity jor citizens to be involved in all phases of the planning process. <br /> <br />Response: <br />The City of Eugene has an acknowledged citizen involvement program and an acknowledged <br />process expressed in the Eugene Code for securing citizen input on all proposed plan <br />amendments. It insures the opportunity for citizens to be involved in all phases of the planning <br />process and sets out requirements for such involvement. The an1endments proposed do not <br />amend the acknowledged citizen involvement progran1. The process for adopting these <br />amendments complies with the requirements of the citizen involvement provisions. <br /> <br />Ibe Metro Plan contains an acknowledged citizen involvement program satisfying Goal 1. The <br />citizen invol:vement program is in Metro Plan Chapter III, pp. III-K-l to III-K-4. The proposed <br />amendments comply with and do not affect or amend the citizen involvement element in the <br />Metro Plan. <br /> <br />The proposed Refinement Plan amendment is subject to the public notification and public <br />hearing processes provided for all Type IV application procedures as stipulated in EC 9.7400 <br />throughEC 9.7455, which, along with the remainder of the Code and with Statewide Goals and <br />state statutes, provide the provisions for citizen involvement. <br /> <br />The City's acknowledged program for citizen involvement, including public notice, public <br />hearings at the level of the planning commission and city council, notification of decision and <br />notification of the right of appeal, provides citizens the opportunity to review and make <br />recommendations in written and oral testimony on the proposed amendments to the River <br />RoadJSanta Clara Urban Facilities Plan diagram and the Metro Plan Diagram and on the <br />proposed zone change. In addition, the applicant has been to several Santa Clara Community <br />Organization meetings and plans to continue working with the SCCO by providing project <br />information and soliciting comments and critiques of the proposed development as it advances <br />through the planning and development process.
