. River Road at Green Lane intersection
· River Road at Hunsaker Lane and Irving Road intersection.

The conmlenting agencies determined that the proposal's contribution to the projected "F" Level
of Service at the River Road at Green Lane intersection is negligible, not worsening the
performance. Therefore under this definition, the proposal does not significantly affect that
facility. By a small margin, the proposal worsens the performance of the River Road at Hunsaker
Lane and Irving Road intersection in the plan year. Therefore, it significantly affects that facility
under this definition.

OAR 660-012-0060(3) permits local govemments to approve a PAPA that significantly aftects a
facility \vithout requiring that mitigations bring the facility up to the applicable performance
standards. This is allowed only where the facility is currently operating below the performance
standard and, despite any planned facilities as defined in Section (4) of the TPR, it is also
projected to operate below the performance standard in the plan year. Taking into account an
planned facilities, the TIA demonstrates that these conditions are met at the River Road at
Hunsaker Lane and [rving Road intersection. OAR 660-0l2-0060(3)(c) requires transportation
improvements that mitigate the net impact and avoid further degradation in the development
(opening) year. The TIA used 2008 as the development year in this analysis. The impact analysis
shows that even without mitigation there is no measurable development year degradation of the
facility. Therefore, no mitigation is needed to meet the requirements of OAR 660-012-
0060(3)( c).

Proposed Improvements:
The TIA has shown that the Proposed PAPA significantly aftects only one facility in the plan
year and that the effect in the development year is so minute, the requirements of the TPR can be
met without mitigation. Nonetheless, the applicant and commenting agencies have informally
agreed that certain improvements to the existing facilities are desired. Because these
improvements will be specified in conditions of approval for the proposed PAPA, the proposal
must be reevaluated as conditioned. The planned improvements are offered a.<; '''minor
transportation improvements" as defined OAR 660-0121-0005(15) and pursuant to OAR 660-
012-0060(2)(e). These improvements are:

. Construct an additional Hunsaker Lane westbound approach lane
. Construct an additional Green Lane westbound approach lane.

With the proposed improvements specified as conditions of development, the TIA has
determined that~ measured at the end of the planning period, the proposed amendment will
neither reduce the performance of existing or planned transportation facilities below the
minimum acceptable performance standards identified in TransPlan, nor worsen the
performance of transportation facilities that are otherwise projected to perform below the
minimum acceptable performance standard identified in TransPlan. Therefore, potential impacts
under OAR 660.0l2.0060(1)(c)(B) and (C) are avoided.

Conclusion:

Santa Clara -- Refinement Plan Amendment Application
Written Statement m August 2, 2007
