<br />II. LAND USE REQUEST <br /> <br />The applicants 'Vvish to change the zone of the subject site. The applicant is proposing to change <br />the zoning for the portion of the subject site north of Green Lane from PL, Public Land and C-1, <br />Neighborhood Commercial to C-2fPD/SR, Community Commercial with Planned Unit <br />Development and Site Review Overlay; and to change the zoning for the portion of the subject <br />site south of Green Lane from R-I, Low Density Residential to R-2/PD/SR, Medium Density <br />Residential with Planned Unit Development and Site Review Overlay. It is also concurrent with a refmemcnt plan amendment to the River <br />Road/Santa Clara Urban Facilities Plan, the applicable adopted refmement plan. Therefore, <br />pursuant to EC 9.7045 "Description of Quasi-judicial Decisions Type U, Type III, Type IV" the <br />concurrent procedure for this application is Quasi-judicial Decision Type IV. The proposed <br />Metro Plan amendment and the proposed refinement plan anlendment would change the subject <br />site's plan designation to Medium Density Residential and Commercial. In addition the <br />refinement plan amendment includes text changes to the River Road/Division subarea <br />recommendations (p. 2-32). A description of the site, relevant application infoffilation, and <br />supportive facts and findings are outlined in the sections below. <br /> <br />The applicant, Santa Clara Properties, LLC is preparing to submit applications to the City for <br />pennits to build a residential and commercial mixed use development on the subject site. <br />Appropriate zoning for such development under the Eugene Land Use Code is R-2, Medium <br />Density Residential and C-2, Community ConunerciaL Site Review Overlay (!SR) is required <br />per EC 9.8860(2) Overlay Zone requires that "the overlay zone can be applied in re!>pol1se to <br />adopted plan policies or where the use of the overlay zone is necessary to address future <br />development considerations"; in this case the adopted RRlSC policy in EC 9.961O(3)(b) applies <br />the requirement for an overlay zone in order to ensure that appropriate siting standards are <br />employed with expansions of commercial development.
