<br />......~, <br /> <br />"I. <br /> <br />Industrial Corridor area has different soil types and fewer septic <br />disposal systems than the River Rbad and Santa Clara areas. <br /> <br />E. The cost to property owners of annexation and sewer connection <br />is substantial and can consume much of - the capital needed for <br />investment in development or redevelopment of the properties. The <br />City wishes to encourage development or redevelopment of the <br />properties in the Industrial Corridor. <br /> <br />F. The parties desire to resolve issues that may arise as <br />properties in the Industrial Corridor area annex to the City of <br />Eugene, and develop or require sewer or other urban services. The <br />parties have agreed on mutual obligations, rights, and <br />responsibilities and desire to enter into binding long-term <br />commitments for their 'mutual benefit. <br /> <br />AGREEMENT <br /> <br />\ <br /> <br />1. Scope of Aqreement. The parties, in consideration of the <br />recitals, mutual covenants and their promises exchanged herein, <br />-agree to be bound by this Agreement in accordance with its terms <br />for the purposes described in the Recitals. <br /> <br />2. Obliqations of the city of Euqene. <br /> <br />2.1 The City, in cooperation with ICCO, agrees to seek from <br />Lane County the amendments to the UL Urbanizable Land zoning <br />subdistrict attached hereto as Exhibit B. If Lane County fails to <br />adopt these changes to the UL Urbanizable Land zoning subdistrict, <br />or changes otherwise agreed to by the parties hereto, within a <br />reasonable period of time, neither party shall be bound by the <br />provisions of Paragraphs 2 and 3 of this Agreement. <br /> <br />, <br /> <br />2 . 1. 1 In the event that Lane County repeals or adopts <br />a material change to the UL urbanizable Land's zoning <br />subdistrict after its adoption, which repeal or change is not <br />supported by both parties to this Agreement, neither party <br />shall be bound thereafter by the provisions of Paragraphs 2 <br />and 3 of this Agreement. <br /> <br />2.2 The City agrees to enter into t:he Annexation and Urban <br />Services Agreement, attached hereto as Exhibit C and incorporated <br />herein by this reference with each property owner in the Industrial <br />Corridor upon the property owner's application for a building <br />permit. <br /> <br />2.2. 1. Prior to 2011, unless otherwise agreed by the <br />City and the affected property owner, the City will not <br />initiate or approve annexation requests before the City <br />governing bodies or initiate or support annexation petitions <br /> <br />Annexation and Urban Services <br />Policy Agreement - Page 2 <br />
